The United Nations Human Rights Council on Wednesday appointed American
Jewish law professor Richard A. Falk - who has compared Israel to the
Nazis - as special investigator on Israeli actions in the territories for a
six-year term.

Falk, who formerly taught international law at Princeton University,
replaces South African professor John Dugard, who was an expert on
apartheid.

Dugard leaves his post in June after seven years. He made waves when he
compared Israeli actions in the territories with apartheid and colonialism.

Falk, in his academic writing, has already stated that a Palestinian
holocaust was in the making.

Yitzhak Levanon, ambassador to the United Nations in Geneva, spoke against
Falk’s appointment in an address to the council on Wednesday.

“In a recent article, [Falk] stated that he did not think it to be “an
irresponsible overstatement to associate the treatment of Palestinians with
the criminalized Nazi record of collective atrocity,” Levanon said.

“He has taken part in a UN fact-finding mission which determined that
suicide bombings were a valid method of ’struggle,’” Levanon said.

“He has disturbingly charged Israel with ‘genocidal tendencies,’ and accused
it of trying to achieve security through ’state terrorism,’” Levanon said.

“Someone who has publicly and repeatedly stated such views cannot possibly
be considered independent, impartial or objective,” Levanon said.

“No one can be a subcontractor for our defense. Mahmoud Abbas cannot constitute a solution for our defensive problems,” opposition leader Binyamin Netanyahu said Wednesday days after Israel announced that it would allow the Palestinian Authority to purchase 600 armored vehicles from Russia and deploy them in the West Bank.

“The idea of entrusting the PA with our security has failed in the past in Gaza and it will also fail in Judea and Samaria,” Netanyahu said at a conference at the Jerusalem Center for Public Affairs. “The notion that we will provide the PA with weapons in its present state and believe that those weapons will protect us is a nonsensical one.”

“Those weapons will be turned against IDF soldiers much faster than we think. This is exactly what happened in Gaza,” Netnayahu said, adding that the government was erring in allowing the delivery of the armored vehicles. “They cannot protect us and Hamas will use these weapons against us. The security problems are the result of policy errors.”

Netanyahu voiced his agreement with a Egyptian President Hosni Mubarak’s recent statement to the effect that there was an Iranian presence in the Gaza Strip.

He also warned that the government’s policy in negotiations with the Palestinians over Jerusalem and the West Bank could cause the situation to deteriorate in those regions, as it had in the North of the country and in the western Negev.

The case of Omar Khadr reaches the Supreme Court of Canada today, when top judges hear arguments on whether Canada should regard the Guantanamo Bay prison facility as legal.

Mr. Khadr, 21, has been in the U.S. military camp since he was shot and detained at the age of 15 and accused of killing a U.S. soldier in a battle in Afghanistan.

Just down the street in Ottawa, the Federal Court heard the case of Mr. Khadr’s older brother Abdullah, who is seeking the right to document disclosure in his fight against extradition to the United States on charges he once sold weapons to al-Qaeda.

The Khadr family has a long association with al-Qaeda. Hailed as a “martyr” by al-Qaeda after he was killed by the Pakistani army in 2003, the Egyptian-born family patriarch, Ahmed Said Khadr, (pictured) moved his family from Canada to Afghanistan during the 1980s jihad against the Soviets. The senior Mr. Khadr introduced his young children to Osama bin Laden and paramilitary training camps.

The Khadrs may have been compelled to leave behind their involvement in the Afghanistan
jihad, but federal agents complain they have replaced it with a “judicial jihad” in Canada and have become a legal industry unto themselves and a force to be reckoned with.

Their devotion to the global spread of militant Islam has frequently tested laws, politicians and judges.

Time and again, the predicament of one Khadr or another has forced officials to decide whether Canada will stand up for its liberal principles and go to bat for its citizens or bend the rules, sidestep issues and sweep sensitive security matters under the carpet.

“The Khadrs, allegedly accused of terrorism acts, test the boundaries of various security provisions,” said long-time family lawyer Dennis Edney.

“What better cases are there than the Khadrs?” said Mr. Edney, who says his clients could expose Canada’s relationships with countries that arbitrarily detain, torture or “disappear” prisoners.

The Khadrs have fought many battles on both military and legal fronts, influencing Canadian law and creating dilemmas for the courts and government.

Canada court to hear Guantanamo detainee’s case

OTTAWA, Canada (AP) — Canada’s Supreme Court will hear arguments Wednesday about the legality of the detention of a Canadian detainee at Guantanamo Bay, Cuba, an event that essentially puts the U.S. military war-crimes trial system on trial in a foreign jurisdiction.

The detainee can raise the issue of legality of his detention and forthcoming trial at Guantanamo Bay.

Omar Khadr’s attorneys are arguing that interviews with the terrorism suspect by Canadian intelligence officials at Guantanamo violate Canada’s bill of rights because U.S. practices at Guantanamo are at odds with international human rights law.

The court is to decide whether the Canadian government should release details about his interviews with Canadian officials in 2003 and 2004 so that the lawyers can provide a full defense against U.S. charges.

Khadr is charged with killing a U.S. soldier in a 2002 firefight in Afghanistan when he was 15.

The Supreme Court ruled last week that Khadr’s attorneys could raise the legality of his detention and forthcoming trial in Guantanamo when they make their arguments that the interviews should be released.

Khadr’s attorneys are hoping the Supreme Court comments on the U.S. military base when they rule.

“Canada is going to have to consider whether the U.S. is beyond the rule of law,” said Dennis Edney, a Khadr attorney.

The lawyers cite violations of juvenile justice rules set out by the U.N. Convention on the Rights of the Child, noting that Khadr was a teenager when he was captured. They also point to international agreements on civil and political rights and the treatment of prisoners.

Canada’s Justice Department, in its brief to the court, dismissed the efforts by Khadr’s attorneys as a “fishing expedition in relation to the most sensitive of government-held information.”

The “shocking and sensational” inner workings of an alleged homegrown terror cell were unveiled yesterday in a Brampton court – and included the plotting of an attack “much greater” in scale than the London 2005 bombings that killed 52 people.

In a document made public for the first time, the Crown painted a broad picture of the expected evidence in the trial of a youth who pleaded not guilty to belonging to a terrorist group. The trial opened yesterday.

According to the allegations, the so-called Toronto 18 were attempting to secure a safe house to store weapons and practise military drills, and embarking on a mission to destroy the West – one they should be willing to die for.

Details of the alleged plot, which also included storming Parliament Hill and beheading politicians, emerged in a factum filed by the Crown that described the case against the accused as “shocking and sensational.”

The document contains transcripts of wiretaps and videotapes that include one conversation in which one of the accused speaks of the group’s ambitions.

Bus driver wins Muslim hat dispute

TORONTO, March 26 (UPI) -- A suspended Toronto-area bus driver has been reinstated and allowed to wear his Muslim cap on the job, transit officials said.

York Region Transit, which operates north of Toronto, suspended McGregory Jackman without pay on March 17 for wearing a kufi, a traditional Muslim pill-box-like cap, the Toronto Sun reported.

The newly hired Trinidad native who said he converted to Islam in 2005 told the newspaper he thought he was within the rules based on a notice in the driver’s lounge which said, “except for religious observances, no headgear is permitted.”

Tuesday, York Region Transit General Manager Don Gordon said Jackman will be allowed to wear his kufi while working, and would be paid for the time he was suspended, the Sun said.

Jackman told the newspaper he was relieved but hadn’t received an apology.

Intelligence chief says “several hundred” extremists living in Germany

BERLIN: The head of Germany’s intelligence agency said that “several hundred” Muslim extremists are living in Germany and that al-Qaida is forming a strong base in North Africa, a German magazine reported Monday.

Ernst Uhrlau, who oversees the BND, the Germany intelligence agency, said that “up to 700 people are being surveilled, in different degrees,” according to an interview with Der Spiegel.

He was also quoted by the magazine as saying that “more than a dozen” of those people had made trips to Pakistan and Afghanistan to try to make contact with Islamic extremist groups operating there.

“Converts that end up in extremist groups often tend toward political renegades and absolute intolerance and highest radicalism,” Uhrlau was quoted as saying by the magazine for its special edition on Islam in Europe.

However, he also emphasized that most converts were “friendly people, who discovered Islam in searching for meaning for their lives.”

In the interview with the magazine, Uhrlau underlined that northern Africa was becoming a greater security risk.

The magazine quoted him as saying that German intelligence and security agencies had followed “with great concern” the activities of a “handful of groups” that have settled in the region.

“What’s growing there is bringing a brand new quality of jihad right to our front door,” he was quoted as saying by the magazine.

In a news release on Monday, MEMRI quoted the Turkish Islamist Web sites Velfecr.com and Kudusyolu.com as reporting that demonstrators carried hundreds of Hamas and Hizbullah flags and posters, as well as pictures of the movements’ leaders.

Some of the banners read, “Israel Will Be Destroyed,” “We Will Settle Accounts with the Murderer Israel,” “If Every Muslim Pours Out a Bucket of Water, Israel Drowns,” and “The Way of the Shahids is Our Way.”

Philippines: Hunt for terror suspect continues

US-backed Philippine troops are hunting for a top Indonesian terror suspect believed to have helped plot the 2002 Bali bombings despite suspicion that he was recently killed.

UK: Al-Qaeda jail gang spark riot

Prison Jihad

An al-Qaeda jail gang sparked a brutal riot at Britain’s toughest prison after claiming an inmate insulted one of them.
The Muslim Boys mob armed themselves with socks packed with tinned food as they ambushed rival prisoners in a fearsome revenge attack.
All warders on duty were scrambled into action but it took 10 minutes to quell the violence.
An insider at Belmarsh prison, South East London, revealed: “They attacked a group of non-Muslim prisoners at meal time.
“It was brutal and all hell broke lose. One of them was verbally abused and the fight is thought to have been retaliation.

“They have no qualms about using violence to exert their authority.”

Belmarsh staff have grown furious at what they see as bosses’ soft approach to the gang.
Last year, they battered four officers with pool cues in a riot. And three officers were attacked during a separate incident.

Originally, it is prohibited to kill civilians, women, and children, but certain cases are exempted from this:

1. When all individuals on the enemy side participate in war, as then the term “civilian” would not apply to them.

2. When civilians do things to help militants, as then what they do would be regarded as a “military action.”

3. When warriors use civilians, women, and children as a shield and there is no way for Muslim warriors to reach those militants except by killing those civilians.

4. When the enemies kill Muslim civilians, for then their civilians may be treated the same.

5. When a civilian “accepts” usurping a (Muslim) land, he is considered an occupier, and is not a civilian any more.

In Islam, it is obligatory to liberate any Islamic land from occupation. It should also be known that jihad against the Jews is not because they are Jews, but because they are usurpers and warriors.
