<p>The appeals court ruled that, while the video was “willfully outrageous and deliberately provocative”, there was no evidence Rojas Abbate had intended   “to arouse feelings of hostility… aimed at provoking discrimination, hate, or violence towards Muslims.”</p>
<p>His lawyer, Renaud Bettcher, hailed the ruling, saying:<span style="color: #800000;"><strong> “In a secular and republican society, it is incomprehensible that my client was prosecuted. Blasphemy does not exist in France.”</strong></span></p>
<p>Police arrested Rojas Abbate after local Muslim leaders in Strasbourg reacted with outrage at the video. <span style="color: #800000;"><em>(When DON’T Muslims react with outrage?)</em></span></p>

<p>In a story about the Asia Bibi blasphemy case in  Pakistan, CNN goes out of its way to say that the Qur&#8217;an and Hadith do  not contain a death penalty for blasphemy, thereby implying that Asia  Bibi is in danger of death because of cultural or political factors, not  because of anything that needs to be addressed within Islam. This is a  familiar mainstream media practice when it comes to stories about honor  killing or genital mutilation: the story will inevitably assure the  reader that the practice in question has nothing to do with Islam, and  give no hint of why it is so widely tolerated and practiced in Islamic  countries. This only assures that the human rights establishment will  never address these issues properly, and thus these practices will  continue.</p>
<p><strong>&#8220;Family waits to see if mother, accused of blasphemy, will be hanged&#8221;</strong> by Reza Sayah for <a href="http://www.cnn.com/2010/WORLD/asiapcf/11/18/pakistan.blasphemy/index.html?hpt=C1" target="_blank">CNN</a>, November 18 (thanks to JW):</p>
<blockquote><p>Neither the Koran nor the prophet Muhammad&#8217;s teachings in  the Hadith call for the execution of blasphemers, but Islamic scholars  and jurists from generations past included the death sentence when  drafting Islamic law.</p></blockquote>
<p><a href="http://www.islam-qa.com/en/ref/22809" target="_blank">Islam QA</a> disagrees, and uses both Qur&#8217;an and Hadith to make its argument:</p>
<p><span id="more-64751"></span></p>
<blockquote><p>I heard on a tape that whoever insults the Prophet (peace  and blessings of Allaah be upon him) should be executed even if he shows  that he has repented. Should he be killed as a hadd punishment or  because of kufr? If his repentance is sincere, will Allaah forgive him  or will he go to Hell and his repentance will be of no avail?Praise be to Allaah.</p>
<p>The answer to this question may be given by addressing the two following issues:</p>
<p>1 &#8211; The ruling on one who insults the Prophet (peace and blessings of Allaah be upon him)</p>
<p>The scholars are unanimously agreed that a Muslim who insults the  Prophet (peace and blessings of Allaah be upon him) becomes a kaafir and  an apostate who is to be executed. This consensus was narrated by more  than one of the scholars, such as Imaam Ishaaq ibn Raahawayh, Ibn  al-Mundhir, al-Qaadi &#8216;Iyaad, al-Khattaabi and others. Al-Saarim  al-Maslool, 2/13-16</p>
<p>This ruling is indicated by the Qur&#8217;aan and Sunnah.</p>
<p>In the Qur&#8217;aan it says (interpretation of the meaning):</p>
<p>&#8220;The hypocrites fear lest a Soorah (chapter of the Qur&#8217;aan) should be  revealed about them, showing them what is in their hearts. Say: &#8216;(Go  ahead and) mock! But certainly Allaah will bring to light all that you  fear.&#8217;</p>
<p>If you ask them (about this), they declare: &#8216;We were only talking  idly and joking.&#8217; Say: &#8216;Was it at Allaah, and His Ayaat (proofs,  evidences, verses, lessons, signs, revelations, etc.) and His Messenger  that you were mocking?&#8217;</p>
<p>Make no excuse; you disbelieved after you had believed&#8221;</p>
<p>[al-Tawbah 9:64-66]</p>
<p>This verse clearly states that mocking Allaah, His verses and His  Messenger constitutes kufr, so that applies even more so to insulting.  The verse also indicates that whoever belittles the Messenger of Allaah  (peace and blessings of Allaah be upon him) is also a kaafir  [unbeliever], whether he was serious or joking.</p>
<p>With regard to the Sunnah, Abu Dawood (4362) narrated from &#8216;Ali that a  Jewish woman  used to insult the Prophet (peace and blessings of Allaah  be upon him) and say bad things about him, so a man strangled her until  she died, and the Prophet (peace and blessings of Allaah be upon him)  ruled that no blood money was due in this case.</p>
<p>Shaykh al-Islam Ibn Taymiyah said in al-Saarim al-Maslool (1/162):  This hadeeth is jayyid, and there is a corroborating report in the  hadeeth of Ibn &#8216;Abbaas which we will quote below.</p>
<p>This hadeeth clearly indicates that it was permissible to kill that  woman because she used to insult the Prophet (peace and blessings of  Allaah be upon him).</p>
<p>Abu Dawood (4361) narrated from Ibn &#8216;Abbaas that a blind man had a  freed concubine (umm walad) who used to insult the Prophet (peace and  blessings of Allaah be upon him) and say bad things about him. He told  her not to do that but she did not stop, and he rebuked her but she did  not heed him. One night, when she started to say bad things about the  Prophet (peace and blessings of Allaah be upon him) and insult him, he  took a short sword or dagger, put it on her belly and pressed it and  killed her. The following morning that was mentioned to the Messenger of  Allaah (peace and blessings of Allaah be upon him). He called the  people together and said, &#8220;I adjure by Allah the man who has done this  action and I adjure him by my right over him that he should stand up.&#8221;  The blind man stood up and said, &#8220;O Messenger of Allaah, I am the one  who did it; she used to insult you and say bad things about you. I  forbade her, but she did not stop, and I rebuked her, but she did not  give up her habit. I have two sons like pearls from her, and she was  kind to me. Last night she began to insult you and say bad things about  you. So I took a dagger, put it on her belly and pressed it till I  killed her.&#8221; Thereupon the Prophet (peace and blessings of Allaah be  upon him) said: &#8220;Bear witness, there is no blood money due for her.&#8221;</p>
<p>(Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 3655)</p>
<p>It seems that this woman was a kaafir, not a Muslim, for a Muslim  could never do such an evil action. If she was a Muslim she would have  become an apostate by this action, in which case it would not have been  permissible for her master to keep her; in that case it would not have  been good enough if he were to keep her and simply rebuke her.</p>
<p>Al-Nasaa&#8217;i narrated (4071) that Abu Barzah al-Aslami said: A man  spoke harshly to Abu Bakr al-Siddeeq and I said, &#8216;Shall I kill him?&#8217; He  rebuked me and said, &#8216;That is not for anyone after the Messenger of  Allaah (peace and blessings of Allaah be upon him) .&#8217;&#8221; (Saheeh  al-Nasaa&#8217;i, 3795)</p>
<p>It may be noted from this that the Prophet (peace and blessings of  Allaah be upon him) had the right to kill whoever insulted him and spoke  harshly to him, and that included both Muslims and kaafirs.</p>
<p>The second issue is: if a person who insulted the Prophet (peace and  blessings of Allaah be upon him) repents, should his repentance be  accepted or not?</p>
<p>The scholars are agreed that if such a person repents sincerely and  regrets what he has done, this repentance will benefit him on the Day of  Resurrection and Allaah will forgive him.</p>
<p>But they differed as to whether his repentance should be accepted in  this world and whether that means he is no longer subject to the  sentence of execution.</p>
<p>Maalik and Ahmad were of the view that it should not be accepted, and that he should be killed even if he has repented.</p>
<p>They quoted as evidence the Sunnah and proper understanding of the ahaadeeth:</p>
<p>In the Sunnah, Abu Dawood (2683) narrated that Sa&#8217;d ibn Abi Waqqaas  said: &#8220;On the Day of the Conquest of Makkah, the Messenger of Allaah  (peace and blessings of Allaah be upon him) granted safety to the people  except for four men and two women, and he named them, and Ibn Abi  Sarh&#8230; As for Ibn Abi Sarh, he hid with &#8216;Uthmaan ibn &#8216;Affaan, and when  the Messenger of Allaah (peace and blessings of Allaah be upon him)  called the people to give their allegiance to him, he brought him to  stand before the Messenger of Allaah (peace and blessings of Allaah be  upon him). He said, &#8220;O Prophet of Allaah, accept the allegiance of  &#8216;Abd-Allaah.&#8221; He raised his head and looked at him three times, refusing  him, then he accepted his allegiance after the third time. Then he  turned to his companions and said: &#8220;Was there not among you any smart  man who could have got up and killed this person when he saw me refusing  to give him my hand and accept his allegiance?&#8221; They said, &#8220;We do not  know what is in your heart, O Messenger of Allaah. Why did you not  gesture to us with your eyes?&#8221; He said, &#8220;It is not befitting for a  Prophet to betray a person with a gesture of his eyes.&#8221;</p>
<p>(Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 2334)</p>
<p>This clearly indicates that in a case such as this apostate who had  insulted the Prophet (S), it is not obligatory to accept his repentance,  rather it is permissible to kill him even if he comes repentant.</p>
<p>&#8216;Abd-Allaah ibn Sa&#8217;d was one of those who used to write down the  Revelation, then he apostatized and claimed that he used to add whatever  he wanted to the Revelation. This was a lie and a fabrication against  the Prophet (peace and blessings of Allaah be upon him), and it was a  kind of insult. Then he became Muslim again and was a good Muslim, may  Allaah be pleased with him. Al-Saarim 115.</p>
<p>With regard to proper understanding of the ahaadeeth:</p>
<p>They said that insulting the Prophet (peace and blessings of Allaah  be upon him) has to do with two rights, the right of Allaah and the  right of a human being. With regard to the right of Allaah, this is  obvious, because it is casting aspersions upon His Message, His Book and  His Religion. As for the right of a human being, this is also obvious,  because it is like trying to slander the Prophet (peace and blessings of  Allaah be upon him) by this insult. In a case which involves both the  rights of Allaah and the rights of a human being, the rights of the  human beings are not dropped when the person repents, as in the case of  the punishment for banditry, because if the bandit has killed someone,  that means that he must be executed and crucified. But if he repents  before he is caught, then the right of Allaah over him, that he should  be executed and crucified, no longer applies, but the rights of other  humans with regard to qisaas (retaliatory punishment) still stand. The  same applies in this case. If the one who insulted the Prophet (peace  and blessings of Allaah be upon him) repents, then the rights of Allaah  no longer apply, but there remains the right of the Messenger of Allaah  (peace and blessings of Allaah be upon him), which still stand despite  his repentance.</p>
<p>If it is said, &#8220;Can we not forgive him, because during his lifetime  the Prophet (peace and blessings of Allaah be upon him) forgave many of  those who had insulted him and he did not execute them?&#8221; The answer is:</p>
<p>The Prophet (peace and blessings of Allaah be upon him) sometimes  chose to forgive those who had insulted him, and sometimes he ordered  that they should be executed, if that served a greater purpose. But now  his forgiveness is impossible because he is dead, so the execution of  the one who insults him remains the right of Allaah, His Messenger and  the believers, and the one who deserves to be executed cannot be let  off, so the punishment must be carried out.</p>

<p>Insulting the Prophet (peace and blessings of Allaah be upon him) is  one of the worst of forbidden actions, and it constitutes kufr and  apostasy from Islam, according to scholarly consensus, whether done  seriously or in jest. The one who does that is to be executed even if he  repents and whether he is a Muslim or a kaafir. If he repents sincerely  and regrets what he has done, this repentance will benefit him on the  Day of Resurrection and Allaah will forgive him.</p>
<p>Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) wrote a  valuable book on this matter, entitled al-Saarim al-Maslool &#8216;ala Shaatim  al-Rasool  which every believer should read, especially in these times  when a lot of hypocrites and heretics dare to insult the Messenger  (peace and blessings of Allaah be upon him) because they see that the  Muslims are careless and feel little protective jealousy towards their  religion and their Prophet, and they do not implement the shar&#8217;i  punishment which would deter these people and their ilk from committing  this act of blatant kufr [unbelief].</p>
<p>And Allaah knows best. May Allaah send blessings and peace upon our Prophet Muhammad and all his family and companions.</p></blockquote>

<p>Lawyer-by-training and German by naturalisation Aygül Özkan  sees German courts as an “alien authority” and would like to see more<strong> Turkish Muslims in the judiciary. </strong><strong>Özkan recently caused an uproar when she called for the removal of cruzifixes from German classrooms.</strong> Since German police is unable to cope with large numbers of increasingly aggressive, criminal gangs of Mohammedan &#8216;youth&#8217;<strong> the import of Turkish policemen is being suggested. </strong>Nobody seems to realize that Turkish police would side with the criminals, because Muslim loyalties always lie with other Muslims, never with the infidel nation state.</p>

<p>Now Aygül Özkan<strong> </strong><a href="http://www.nwzonline.de/index_aktuelles_politik_nachrichten_artikel.php?id=2391776&amp;/Aktuelles/Politik/Nachrichten/NWZ/Artikel/2391776/Ministerin+will+Medien+Inhalte+vorgeben.html" target="_blank"><strong>is about to introduce a “Media Charter”</strong></a> for Lower Saxony. During a collective act on August 16 in Hannover, the invited media representatives are supposed to sign this so-called <strong>“Media Charter on Integration”.</strong> The written invitation says that the collective declaration of intent is supposed to generate a publicity effect and all undersigned will have to pledge themselves to <strong>“strongly support the integration process in Lower Saxony”.</strong></p>
<p>Özkan’s ministry demands the media use “culturally sensitive” language  to further “intercultural openness (which is, of course, humbug, because the term “intercultural” is a one-way-street and don’t we all know the “intercultural openness” of Muslims towards the West), to improve their “intercultural competence” (ditto), to initiate relevant projects and to cover them as journalists.</p>
<p>The NWZ goes on:</p>
<blockquote><p><span style="color: #800000;"><strong>It is so far unique in Germany for the government of a federal state to pledge the media to a collective content and even the language used for that.</strong></span></p></blockquote>
<p>How very daring! But while Özkan had gotten a lot of backslapping by the media for her attempt at removing the crucifix from the public eye (who wants religion anyway, at least as long as it’s Christian), by getting at the media itself, she went too far and didn’t come by the usual fawning reception to which she must be used by now.</p>
<p>Here we have a woman, young, “modern”, seemingly perfectly assimilated, educated to university level, the lot, yet the first thing she sets her mind on in her high office, even before she is sworn in, is the banning of the Christian symbol from schools and,<strong> not even three months later, the abolition of the freedom of the press in favour of her fellow Muslims. </strong>Because in spite of all the “integration” and “people with a migration background” hogwash it’s just about one thing: Islam. Just as for this woman, young, “modern”, seemingly perfectly assimilated, educated to university level, everything is about Islam.  Islam, nothing else matters&#8230;&#8230;</p>

<p>When Aygül Özkan was appointed by former Prime Minister Christian Wulff to become the first Muslim minister in Germany, there was doubt whether the contradiction between Islamic teachings and our Basic Law could always be regulated in the secular sense. For the first time in the history of the Federal Republic of Germany this minister would like to shake down the freedom of the press granted in the Basic Law. Media are to commit themselves officially to only report to certain topics in a sense specified first and with arranged language. Guess  which topics this could be&#8230;.?</p>

<p>&#8220;&#8230;Freedom of speech is constitutionally, &#8216;subject to any reasonable restrictions imposed by law in the interest of the glory of Islam.&#8217; &#8230;&#8221;</p>
<p>&#8220;&#8230;Law enforcement personnel abused religious minorities in custody. Security forces and other government agencies did not adequately prevent or address societal abuse against minorities. Discriminatory legislation and the Government&#8217;s failure to take action against societal forces hostile to those who practice a different religious belief fostered religious intolerance, acts of violence, and intimidation against religious minorities&#8230; &#8221;</p>
<p>&#8220;&#8230;religious minorities are legally restricted from public display of certain religious images&#8230;&#8221;</p>
<p>&#8220;&#8230;The consequences for contravening the country&#8217;s blasphemy laws are death for defiling Islam or its prophets; life imprisonment for defiling, damaging, or desecrating the Qur&#8217;an; and 10 years&#8217; imprisonment for insulting another&#8217;s religious feelings&#8230;&#8221;</p>
<p>&#8220;&#8230;Some individuals bring charges under these laws to settle personal scores or to intimidate vulnerable Muslims, sectarian opponents, and religious minorities&#8230; &#8221;</p>
<p>&#8220;&#8230;The Ministry of Religious Affairs&#8230;has on its masthead a Qur&#8217;anic verse: &#8216;Islam is the only religion acceptable to God&#8230;&#8217; &#8221;</p>
<p>&#8220;&#8230;Authorities routinely used blasphemy laws to harass religious minorities and vulnerable Muslims and to settle personal scores or business rivalries&#8230; &#8221;</p>
<p>&#8220;&#8230;Mobs occasionally attacked individuals accused of blasphemy and their families or their religious communities. When blasphemy and other religious cases were brought to court, extremists often packed the courtroom and made public threats against an acquittal. Religious extremists continued to threaten to kill those acquitted of blasphemy charges. High-profile accused persons often went into hiding or emigrated after acquittal&#8230;&#8221;</p>
<p>&#8220;&#8230;In September 2008 a former federal minister and host of a popular religious television show declared on air that killing Ahmadis was the &#8216;Islamic duty of devout Muslims;&#8217; at least two Ahmadis were killed in Sindh within 48 hours of this declaration&#8230;At the end of the reporting period, the the government continued to stall investigation into the deaths&#8230;&#8221;</p>
<p>&#8220;&#8230;Violence against and harassment of Christians continued during the reporting period&#8230;&#8221;</p>
<p>&#8220;&#8230;In April 2009, at a district court in Nankana Sahib, Punjab, police cleared three men accused of raping a 13-year-old Christian girl despite eyewitness accounts and medical evidence&#8230; &#8221;</p>
<p>&#8220;&#8230;A March 2009 attack on a church and the surrounding neighborhood in Sangu-Wali, a village in Gujranwala, Punjab, left a woman dead. The attack was believed to be prompted after a Christian filed a robbery complaint against a local Muslim who, along with his friends, indiscriminately preyed on the community&#8230;&#8221;</p>

<p><strong><a href="http://www.cnsnews.com/news/article/58825">(CNSNews.com)</a></strong><a href="http://www.cnsnews.com/news/article/58825"> </a>– An Islamic-led campaign against religious “defamation” has taken another blow the United Nations, where support among member states has dropped to a new low amid escalating concerns that defamation resolutions endanger non-Muslims in Islamic societies and harm freedom of expression.</p>
<blockquote><p>While much of the world’s attention was focused on Copenhagen late last week, the U.N. General Assembly passed a range of human rights-related resolutions. For critics of the world body and its Human Rights Council, the results were mixed.</p>
<p>The latest in a string of religious defamation resolutions considered by the General Assembly and human rights bodies over the past decade saw more countries than ever oppose the measure.</p></blockquote>
<p><span id="more-41364"></span></p>

<p>The resolution passed by 80 votes to 61 against, with 42 countries abstaining. The result is the worst ever for the Organization of the Islamic Conference (OIC) member states and their allies, many of them not free democracies. It marks a continuing decline since 2007, when in the wake of the Mohammed newspaper cartoon furor a similar resolution passed by a vote of 108-51, with 25 abstentions.</p>
<p>Not only has the number of countries opposing the move climbed (<a style="outline-width: 0px; outline-style: initial; outline-color: initial; font-weight: inherit; font-style: inherit; font-size: 14px; font-family: inherit; vertical-align: baseline; color: #2c3c69; font: normal normal bold 14px/normal 'trebuchet ms', arial, sans-serif; text-decoration: none; padding: 0px; margin: 0px; border: 0px initial initial;" href="http://www.cybercastnewsservice.org/cns/webuploads/reldef-graph2.JPG" target="_blank">see graph</a>), but several member states in the developing world have moved from supporting the resolutions to abstaining.</p>
<p>Ten countries in Latin America and the Asia-Pacific moved from abstaining in 2008 to opposing the OIC resolution this year – Chile, Mexico, Uruguay, Panama, St. Lucia, Papua New Guinea, East Timor, Vanuatu, Nauru and Tonga.</p>
<p>Another five states which supported the resolution last year abstained this time – Honduras, Jamaica, Bahamas, Antigua and Barbuda and Lesotho.</p>
<p>Moving in the other direction, Liberia, Cape Verde and Belize abstained this year, having opposed the OIC resolution in 2008; and Congo moved from abstaining last year, to supporting the resolution this time.</p>
<p>The OIC argues that Islam and its teachings, symbols and prophetic figures are being denigrated by non-Muslims as a result of ignorance, fear and prejudice.</p>
<p>But critics charge that the OIC is trying to shield Islam, Islamic practices and clerics from legitimate examination, noting that it is in some Islamic countries themselves that non-Muslim beliefs and activities are proscribed.</p>
<p>The drive to have defamation of religion outlawed has triggered a growing counter-campaign by freedom of expression groups, humanist organizations, and advocates for the rights of Christians and other non-Muslim minorities in the Islamic world, including coverts from Islam who are considered “apostates.”</p>
<p>Although the resolutions are non-binding, they are taking place in conjunction with a separate OIC-led push to have an existing, legally-binding anti-racism treaty, the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD), amended to cover speech deemed as religiously defamatory.</p>
<p>In a letter written to member states ahead of the vote, Angela Wu, international law director of the Becket Fund for Religious Liberty – a leading opponent of the resolutions – argued that the measures “provide international support for domestic blasphemy laws that have been used by oppressive regimes to silence, rather than protect, vulnerable minorities and dissenters.”</p>
<p>Wu contested the very concept of religious defamation, saying the human rights law systems is meant to protect individuals, not ideas or religions.</p>

<p><em>The concept of pedophilia did not exist in Muhammad&#8217;s day. His marriage to Aisha was not unusual in the context of the time; but it becomes extremely problematic, and conducive to pedophilia, when Muhammad is held up as the &#8220;excellent example of conduct&#8221; (Qur&#8217;an 33:21) for all time, and followed in this in our own day. And child marriage is indeed common in some areas of the Islamic world &#8212; notably Afghanistan, but it is by no means limited to Afghanistan only.</em></p>
<p><em>In any case, in light of all that, Halla-aho was saying something perfectly reasonable. Lets hope he will be able to bring some of this evidence in his own defense.</em></p>
