The Myths of Islam – Islam Respects Women

Thanks to the RoP via Jawa Report

Another common myth about the ‘Religion of Peace’:

The Myth:

The Qur’an places men and women on equal foundation before Allah. Each person is judged according to his or her own deeds. Women have equal rights under Islamic law.

The Truth:

Merely stating that individuals will be judged as such by Allah does not mean that they have equal rights and roles, or that they are judged by the same standards.

There is no ambiguity in the Qur’an, the life of Muhammad, or Islamic law as to the inferiority of women to men despite the efforts of modern-day apologists to salvage Western-style feminism from scraps and fragments of verses that have historically held no such progressive interpretation.

After military conquests, Muhammad would dole out captured women as war prizes to his men. In at least one case, he advocated that they be raped in front of their husbands. Captured women were made into sex slaves by the very men who killed their husbands and brothers. There are four Qur’anic verses in which “Allah” makes clear that a Muslim master has full sexual access to his female slaves, yet there is not one that prohibits rape.

The Qur’an gives Muslim men permission to beat their wives for disobedience, but no where does it command love in marriage. It plainly says that husbands are “a degree above” wives. The Hadith says that women are intellectually inferior, and that they comprise the majority of Hell’s occupants.

Under Islamic law, a man may divorce his wife at his choosing. If he does this twice, then wishes to remarry her, she must first have sex with another man. Men are exempt from such degradations.

Muslim women are not free to marry whom they please, as are Muslim men. Their husband may also bring other wives (and slaves) into the marriage bed. And she must be be sexually available to him at any time (as a field ready to be “tilled,” according to the holy book of Islam).

Muslim women do not inherit property in equal portion to males. Their testimony in court is considered to be worth only half that of a man’s. Unlike a man, she must cover her head – and often her face.

If a woman wants to prove that she was raped, then there must be four male witnesses to corroborate her account. Otherwise she can be jailed or stoned to death for confessing to “adultery.”

Given all of this, it is quite a stretch to say that men and women have “equality under Islam” based on obscure theological analogies or comparisons. This is an entirely new ploy that is designed for modern tastes and disagrees sharply with the reality of Islamic law and history.

Terrorizing Muslim Women

Nonie Darwish/Frontpage

There is an article floating all over the Internet, “Joys of Muslim Women,” which discusses the horrific truth about how Islam legally treats women. The article claims to have been written by me, but that is false: I am not the author. Let me use this occasion, however, to set a few matters straight:

The silence is deafening around the world in regards to the inhumanity and brutality of Sharia towards women. Most of the activism against stoning, flogging and abuse of women under Sharia is heard from former Muslim women, like myself, and a few others in the West who dare to expose the truth.

Muslim women have no choice but to abide by Sharia, since rejecting it is grounds for the charge of apostasy, punishable by death. Having been exposed to Sharia for centuries, Muslim women have learned convoluted coping mechanisms to avoid Sharia’s wrath. Engaging in their own form of Stockholm Syndrome, most Muslim women publicly defend the very laws that enslave them. Even Obama’s advisor on Islamic affairs, Dalia Mujahed, stated that Sharia is “misunderstood.” Muslim women end up as the guardians of their ownjails. It is women who often report younger girls who refuse to wear the head cover, and some wives cover up for the honor killing of a daughter by their husband or son. Many have accepted their inferior status and wear it as a badge of honor.

That is why there is no significant grass-roots feminist movement in the Muslim world today. Muslim feminists are routinely accused of apostasy — with its death penalty hanging over their heads. The only feminist movements to speak of in the Muslim world occurred during British colonial rule and, on a smaller scale, when the French conquered Egypt in 1798. By the end of the British rule, feminism ended inside the Muslim world.

Many Muslims claim that “Islam honors women” just as they claim that Islam is a “Religion of Peace.” The truth however, is just the opposite. Islam does not honor women, but rather holds their very lives in absolute bondage.

America must outlaw Sharia from ever being practiced by anyone on American soil. If we fail to do this, if we permit Sharia to creep into our legal system, we might as well say goodbye to our freedom. Here are just a few examples of whatMuslim women must live under:

[1] There is no age limit for marriage of girls under Sharia. A man can pay a dowry and sign a marriage contract with parents of a toddler girl and consummate the marriage at age 9. Recent cases in Yemen and Saudi Arabia exposed this tragedy when 8-year-old girls filed for divorce from their over 50-year-old husbands. Not one Muslim authority challenged the Saudi marriage high official, Dr. Ahmad Al Mubi, who stated in 2008, in an interview that aired on LBC TV: “There is no minimal age for entering marriage. The Prophet Muhammad is the model we follow.”

[2] Islamic law states: “a Muslim will not be punished for killing an adulterer.”Islam, therefore, encourages honor killing of women. Since men have more sexual rights than women in Islam, it becomes harder to catch a man committing adultery. Thus women become more susceptible to becoming the victims of theabove law, which allows vigilante street justice against adulterous women. I have never heard a Friday sermon stating that honor killing is forbidden in no uncertain terms.

[3] A rebellious wife is one who “answers her husband coldly” or refuses to go to bed with him. Rebelliousness on the part of the wife nullifies the husband’s obligation to support her and gives him permission to beat her (Shafi Law m10 and m11 p. 541-2). The Prophet said: “A man will not be asked as to why he beat his wife”.–Sunaan Abu Dawud, 11.2142

[4] Divorce is only in the hands of the husband and is as easy as verbally saying “I divorce you.” Thus the wife is divorced whether the husband had the intention to do it or not. Law n3.2 p 559.

[5] There is no community property between husband and wife in Islam. A Muslim wife would be lucky to inherit 20% from her husband. A man’s property after his death is not given to his wife, but is divided among many members of the family such as his parents, other wives; sons take double what daughters get.

[6] A man has the right to have up to 4 wives. Polygamy is not just a right, but loyalty to one wife is discouraged. Mohammed said: “The best Muslims had the largest number of wives,” Bukhari 7.62.7. A Muslim man does not vow loyalty to his bride in the marriage ceremony and the bride must not expect it. In the Muslim marriage contract itself, the husband is asked to give name and address of wife number 1, 2 and 3 if any. (See a copy of the Muslim marriage contract in my book, chapter 2 of Cruel and Usual Punishment.)

[7] Mutaa or pleasure marriage gives the right to a man to marry a woman for a fixed amount of time, from a few hours to several years. That takes away any holiness in the concept of marriage. The only condition is that the man must pay the woman money (dowry) in exchange for sexual rights over her body. This is simply legalized prostitution, exploiting needy and poor women. This form ofmarriage is not registered or regulated by the State.

Urfi marriage is another form of marriage that is usually kept as a secret. Sharia has not forgotten the traveling man and gave him “Misyar” marriage allowing him “wives” in different cities. Sharia satisfies men’s urges at the expense of women’s dignity and humanity with total disregard to limitations and wholesome standards for men to live by for the benefit of a healthy family life.

[8] The Qur’an often uses the word “nikah,” which literally means sexual intercourse, to mean marriage. The dowry is called “ugur” in the Qur’an, meaning wage. It is payment for owning a woman’s private parts to be used by the husband as he wishes. “The dowry is given in exchange for the woman’s sexual organs.” (Ibn Kathir)

[9] A man is allowed to have sex with slave women and women captured in battle, and if they are married their marriage is annulled. Qur’an 4:24: “All married women (are forbidden unto you) save those (captives) whom your right hands possess.” Sharia never abolished slavery and highly regulates it, that is, makes it “regular.” Saudi Arabia officially abolished slavery only as late as 1962 after pressure from the “infidel” Western Judeo-Christian culture. To this day, the Muslim leadership in Egypt and Saudi Arabia refuses to annul slave sexual rights for men in Sharia books.

[10] The testimony of a woman in court is half the value of a man, law o24.7. You can guess who usually wins if a man and woman face each other in court.

[11] Revered Muslim theologian Imam Ghazali (1058-1111) defined marriage for generations of Muslims without apology as: “Marriage is a form of slavery. The woman is man’s slave and her duty therefore is absolute obedience to the husband in all that he asks of her person.”

[12] For a Muslim woman to prove rape, she must have 4 male witnesses. “Proof of adultery and rape will be either confession of accused or eye-witness of four male adult Muslims.” Hudood ordinance #7 of 1989 amended by #8B of 20 of 1990.

[13] A rapist may only be required to pay the bride-money (dowry) without marrying.” law m.8.10, page 535. This law tells the man that all he has to do to rectify a rape is to pay a dowry to the rape victim. Rape is almost always blamed on the girl who must come up with 4 male witnesses, especially if she was not covered up the Islamic way. A Muslim preacher in Australia blamed rape by Muslim men on Australian women whom he described as “uncovered meat.”

[14] The Prophet said, “I looked at Hell and saw that the majority of its inhabitants were women.” Bukhari 4:464. There is a book sold in British mosques entitled: “Women Who Deserve to Go to Hell” by Mansoor Abul Hakim.

[15] A Muslim woman must cover every inch of her body since Islam regards every part of a woman’s body as “Awrah,” a sexual organ. Some sects of Islam demand the covering of the face and others don’t. This kind of extreme cover of even the face deepens the feeling of isolation, gender segregation and becomes the symbol of Islamic submission and presence in the West.

[16] Muslim scriptures describe women as deficient in intellect and faith, toys, crooked, half devils, harmful and detrimental to men. Also the prophet stated:“After me I have not left any affliction more harmful to men than women.” Bukhari V 7, B 62/33. “A woman’s jihad is to please her husband” is taught by some Muslim women websites such as Takva.com, posted on 11-2-2008.

This article is dedicated to Sakine Mohammadi Ashtiani, an Iranian woman in jail who is awaiting death by stoning for alleged adultery. Under international pressure, Iran just announced that her stoning is “postponed.” But the regime still plans to execute her.

It’s quite surprising what you find blatantly expressed in the Islamic texts that few Muslims actually give a thought about.

I am guilty of that myself.

As a child I had always recited verses that mentioned ‘right hand possessions’, but it was only a few years ago that I wondered what that meant. Looking through the related hadiths and tafseers (exegeses), I was shocked to learn that it referred to sexual slaves. It seems that widows and children of non-Muslim men, who were killed in battles waged by Muslims during the Islamic prophet, Muhammad’s time, were taken in as sexual slaves. (More than 70 battles were waged. All but one were offensive.)

In denial the way a child would deny his father is a rapist, I counselled fellow religious friends from the Muslims Student Association about the issue (I later realized that the MSA is an Islamic supremacist group with ties to the Muslim Brotherhood and Saudi Arabia). I asked them innocently what the term ‘right hand possessions’ means in the Quran. The ‘brothers’ confirmed what I wished not to hear. And, with absolutely no shame about it and a grin on their faces, they told me it’s a matter that should never be brought up in front of kafirs (infidels).

This concept of concealing your faith to protect or propagate Islam is called taqiyyah. Muslims in Europe are not as concerned about that anymore and are more brazen about what they want to do to European women.

This really should have been no surprise to me, though, given the fact that the Islamic prophet himself had sex slaves, or forced widows to marry him:

Rayhana bint Zaid bin Amru was 15 and Muhammad was 56 years old when he attached the Jewish tribe of Banu Qariiza. He took her as a sex slave after she refused to convert to Islam to be his wife.

Juwayriya bint al-Harith was 20 and Muhammad was 58 years old when the Muslims attacked her Jewish tribe, the Banu Mustaliq. She was taken as a sex slave for one of the Muslims. She begged Muhammad to free her, and he allowed that on the condition she marry him.

Safiyyah bint Huyayy was 17 and Muhammad was 60 years old when he attacked the Jews of Khaybar and tortured her husband to death. On their first night, she was a right hand possession, and was lately swiftly made to marry him (as if the mock marriage makes it all morally justifiable…)

Maria the Copt was a Christian slave Muhammad received as a gift from a ruler in Egypt.

A video made by Zaki Ameen that shows the naked truth as it is. Warning: Sexually explicit content!

At the end of this article is a comprehensive list of verses and supporting hadiths that indicate clearly that not only were concubines permitted and encouraged, but that the rapists (no euphemism here) were discouraged by Muhammad from performing coitus interruptus. Yes, they actually had to keep their penises inside while ejaculating, thus potentially adding a permanent memory of the rape.

The list is comprehensive, but I am no genius here. Not long ago, I happened to run into an interesting series of Arabic YouTube videos on the matter (Part 1, Part 2, and Part 3).

The videos show an interview an Iqra channel hostess had with two Islamic scholars. She is asking them how Muslims can respond to accusations that Islam permits concubinage. The scholars’ reactions are rather telling, with one sheikh engaging in mental gymnastics and beating around the bush, and the other scowling at her, scolding her, and even walking off the show for a while in order to avoid answering.

This interview is not run by a bunch of Islam bashers or haters or Jews, or whatever fake demons a Muslim has in his or her mind. It’s run by a religious presenter with two sheikh guests, on a Saudi channel. Their reaction reminds me of how the following Quranic verses (5:101-2):

The hostess, Basma Wahba, eventually removed her hijab. People can only tolerate stupidity to a certain level, and to Basma Wahba, she saw the stupidity she lived in under the hijab after her revealing experience with those scholars.

I had the evidence below and the videos shown to some Muslim sisters, who reacted in denial and anger at me.
My message to my angry Muslim sisters is this: Truth stands against doubt, so don’t fear doubt. God will never punish you for using your minds.

Narrated ‘Urwa bin Az-Zubair: that he asked ‘Aisha, saying to her, “O Mother! (In what connection was this Verse revealed):
‘If you fear that you shall not be able to deal justly with orphan girls (to the end of the verse) that your right hands possess?” (4.3) Aisha said, “O my nephew! It was about the female orphan under the protection of her guardian who was interested in her beauty and wealth and wanted to marry her with a little or reduced Mahr. So such guardians were forbidden to marry female orphans unless they deal with them justly and give their full Mahr; and they were ordered to marry women other than them.”‘Aisha added, “(Later) the people asked Allah’s Apostle, for instructions, and then Allah revealed: ‘They ask your instruction concerning the women . . . And yet whom you desire to marry.’ (4.127) So Allah revealed to them in this Verse that-if a female orphan had wealth and beauty, they desired to marry her and were interested in her noble descent and the reduction of her Mahr; but if she was not desired by them because of her lack in fortune and beauty they left her and married some other woman. So, as they used to leave her when they had no interest in her, they had no right to marry her if they had the desire to do so, unless they deal justly with her and gave her a full amount of Mahr.”

The verse was revealed because some of the female ‘war booty’ were already married and the rapists told the their prophet that they disliked having relations with them if they are already married.

Obama throws women under the bus

Obama is not in favor with at least one blogger at the generally reliably dhimmi Economist. “Next time he would do better to remember, as the secretary of state famously put it, that women’s rights are human rights.” Indeed.

“Throwing women under the bus,” from The Economist Democracy in America blog, June 5 (thanks to JW):

Caroline Glick is unimpressed:

He spoke of the need to grant equality to women without making mention of common Islamic practices like so-called honor killings, and female genital mutilation. He ignored the fact that throughout the lands of Islam women are denied basic legal and human rights. And then he qualified his statement by mendaciously claiming that women in the US similarly suffer from an equality deficit. In so discussing this issue, Obama sent the message that he couldn’t care less about the plight of women in the Islamic world.

So, too, Obama spoke about the need for religious freedom but ignored Saudi Arabian religious apartheid. He talked about the blessings of democracy but ignored the problems of tyranny.

In short, Obama’s “straight talk” to the Arab world, which began with his disingenuous claim that like America, Islam is committed to “justice and progress, tolerance and the dignity of all human beings,” was consciously and fundamentally fraudulent. And this fraud was advanced to facilitate his goal of placing the Islamic world on equal moral footing with the free world.

Nor does it end there; according to her, “Islamic law would provide benefits for women similar to those of American women, such as equality between the genders … and the ability to choose what to wear without discrimination.” Obviously, she has another Islamic law in mind.

“A Woman in the Muslim Brotherhood,” from Jacksonville.com, via JW

The Muslim Brotherhood in Egypt would give more freedom for all aspects of Egyptian society, including women, if the movement achieved power in the country, a female member of the group said.

* Yep. The freedom of the burka. How good is that?

Hiba, whose name has been changed to protect her identity, is a member of the Muslim Brotherhood. The 28-year-old said she joined the party nine years ago because the party’s plans include social as well as religious and political concerns. Although the Muslim Brotherhood was founded in 1928, it remains banned in Egypt. Because of its illegal status in Egypt, the Muslim Brotherhood is not recognized by the U.S. government, although it is not listed as a terrorist organization.[...]

While the Brotherhood is Egypt’s largest opposition party, the current government makes it difficult to join parties other than the ruling National Democratic Party, led by current president Hosni Mubarak, according to Hiba and other Egyptians. Hiba said the Mubarak regime has not allowed the Muslim Brotherhood to take the parliamentary seats it won in the 2005 elections. She added that some government branches, such as the Minister of Information, create problems for women who adhere to the Islamic dress code, even though the constitution of Egypt lists the state religion as Islam. This discrimination against veiled women, Hiba said, exists regardless of whether they are affiliated with the Muslim Brotherhood. For example, the Minister of Information controls the state-owned broadcast stations anddoes not allow female presenters to wear a headscarf on-air, even though adherence to the rules of hijab has recently increased among Egyptian women.

For Hiba, the Muslim Brotherhood’s goals of instituting Islamic law would provide benefits for women similar to those of American women, such as equality between the genders, job opportunities, free elections, more seats in ministries and Parliament, and the ability to choose what to wear without discrimination.

“American women have all these rights; I wish I had these rights,” Hiba said…

The Qur’an sanctions the beating of disobedient women (4:34).

Muslim women are staying away from a domesitc violence crisis centre since a mosque opened next door.

The Auckland Shakti Asian Women’s Centre in Onehunga helps women escape violent domestic situations but women are too scared to go because they may be recognised by their husbands or relatives attending the mosque.

The centre has an alternative premises but cannot move in because Auckland City Council has held back planning permission for more than a year.

Meanwhile, Housing New Zealand Corporation is paying $310 a week $4030 so far for security guards to keep vandals away from the empty building that the women could move into.

Centre spokesperson Shila Nair said victims were “really afraid” to go to the centre in Church St, Onehunga in case they were recognised by men worshipping at the Onehunga Islamic Mosque, which is over a boundary fence.

Women who visited the centre usually did so without telling their husbands, she said. “If their husbands, in-laws or any other family members or friends were to know that they have visited Shakti, life for them would be even more difficult. We have had instances of women who visited our Women’s Centre later accessing our refuge.”

Most were from Middle Eastern, Africa and Asian countries that don’t legislate against domestic violence. Staff tell them what their rights are under New Zealand law.

The crisis centre took 4800 phone calls last year on a 24 hour nationwide helpline of which 90% were about family violence. Of the calls, half of the women were recommended to visit for counselling, legal advice or training.

The housing corporation renovated another building for the women to move to after the mosque bought a building next door from the Jehovah’s Witness church. The women have been waiting for 18 months for the council to grant resource consent for them to use the house. Council resource consents team leader Ian Smallburn said the consent was “on hold” because of concerns about the impact of parking on neighbours, trees and stormwater. It was not known when the issues would be resolved.

The centre opened a decade ago and is the busiest of Shakti’s five branches in Auckland, Tauranga and Christchurch, which together they help 6000 women a year escape domestic abuse.

You can judge the health of any society by how they treat the women. From the wonderful world of secular Islam:

Health Workers Facilitate Wife Beating Digital Journal

Although it is condemned by helping organizations around the world, wife beating is common in many places. What’s worse is when health workers facilitate or condone it as recently reported in a study done in Turkey.

In Turkey which has wife-beating virtually institutionalized, a high percentage of health workers don’t respond or work with the victims of domestic violence in sympathetic ways. That’s because the culture accepts wife- beating. On a questionnaire 69.0% of the female and 84.7% of the male health workers stated that the agreed to or partially agreed to at least one reason to excuse physical violence.

The accepted grounds for beating one’s wife in Turkey includes criticizing the man, lying to him or refusing to care for the children. Deceiving the husband is the most serious offense with over half of female doctors agreeing that the man should be able to punish the wife physically if the wife deceived him. These are accepted grounds also for honor killings.

Because of the cultural rigidity on the matter of approving wife-beating most health care workers in Turkey don’t know the legal issues nor is there any real training in the country to help medical personnel identify and report signs of physical abuse.

Wife-beating “virtually institutionalized” in modern, moderate, secular Turkey

Spousal abuse is found in all countries and cultures, but only in Islam does it have divine sanction: “Men have authority over women because God has made the one superior to the other, and because they spend their wealth to maintain them. Good women are obedient. They guard their unseen parts because God has guarded them. As for those from whom you fear disobedience, admonish them and send them to beds apart and beat them.” — Qur’an 4:34

VIOLENCE AGAINST WOMEN: JORDAN, 20% APPROVE TO BE BEATEN

AMMAN, NOVEMBER 25 – Around 20 percent of Jordanian women approve being beaten by husbands to discipline them, according to a survey conducted by the department of statistics that was published today.

The study included nearly 15,000 families and 11,000 women who got married, said the report. Most of the respondents aged between 15 to 49 years old. Luck Steve, representative of UN Agencies which helped conduct the study, said measures must be taken to fight violence against women following surprising results of the survey. “The result of the survey shows we have work to do regarding state of women in the society and how they are being treated,” said Steve. The study was conducted during 2007 and made public during a public ceremony held at the department of statistics. Activists have been campaigning to improve conditions of women in this tribal community, but they are faced with resistance from traditional politicians. Queen Rania has been pushing for more rights to women since she was crowned nine years ago, with her efforts resulting in allowing married women to divorce their husbands, a measure that has been an exclusive right for men since decades. Every year between 15 to 20 women are killed in the name of honour, with killers receiving sentences for just a few months behind bars. (ANSAmed).

TURKEY: REPORT REVEALS HORRORS OF VIOLENCE AGAINST WOMEN

(ANSAmed) – ANKARA, NOVEMBER 26 – A shocking one out of every three women in Turkey are subject to physical violence. This alarming data comes from the report ‘Violence against Women in Turkey’ prepared this year by academics Ayse Gul Altinay and Yesim Arat, as Turkish dailies report today. “Excuses for Domestic Violence in Turkey and Recommendations from Women Victims on How to Avoid Violence” is the title of another report issued by the Turkey’s Compassion Association of Konya to reveal the horrors of domestic violence against women. According to daily Today’s Zaman the report is the result of the association’s findings after speaking with the 9,000 women and girls who have fallen victim to domestic violence and sought shelter with the Compassion Association, which runs women’s and refugees’ shelters and works on behalf of oppressed peoples, since 1995. The report details the excuses Turkish men use for beating their wives: “The woman’s not wanting to engage in sexual activity; the woman’s gaining weight; her inability to bear children or not bearing a male child; the food shés cooked being too salty, burnt, cold or not according to the man’s tastes; not doing a good job ironing his clothing; being late in answering the door when hés come home and knocked; the woman’s getting ill or not getting better after getting ill and leaving the home without permission”. The report also lists some of the disturbing forms of domestic violence including the “striking of the face, eyes, head, chest, back and knees by punching, kicking, caning or using a belt”. Some further extremes include slinging caustic liquids such as acid at women’s faces, pouring boiling-hot water, tea or coffee on her, extinguishing cigarettes directly on women’s exposed skin and wounding women using knives.
Islam in the media – Domestic violence and polygamy

‘Some Muslim religious leaders are condoning domestic violence, rape within marriage, polygamy, welfare fraud and exploitation of women, according to a new Report prepared by the Islamic Women’s Welfare Council of Victoria’.(1)

Barney Zwartz, writing in The Age, said the Report also says “some imams perform polygamous marriages knowing that the second wife, a de facto under Australian law, can claim Centrelink payments.” His article has extensive quotes and details from the Report. The actual Report is not available online.

The study was funded by the previous Howard government and its’ Muslim Community Reference Group and the final Report was presented at the National Centre of Excellence in Islamic Studies Conference in Melbourne on 19-20 November 2008. Click here for details of the Conference and speakers. The NCEIS was also funded under the same program by the Howard Government.

Some of these claims have been made before, but the fact that they are made in a Report published by a Muslim women’s group is very significant.

Responses from Australia’s Muslim Mufti Sheikh Fehmi:

The Victorian Board of Imams rejected the Report by the Islamic Women’s Welfare Council of Victoria.

In the same article, Barney Zwartz reported:

“The secretary of the Board of Imams, Sheikh Fehmi Naji El-Imam, said he could not understand how the council could write such a report and denied the complaints “absolutely”. “They must have heard stories here and there and are writing about them as though they are fact,” he said.

Sheikh Fehmi, who is also Mufti of Australia, said no authorised imam would conduct a polygamous marriage, and it was absolutely wrong that women’s rights were ignored in marriage or divorce, or that imams ignored domestic violence. “I haven’t heard of any case where the board disregarded a woman or did not try to help her,” he said.

Perhaps it depends on how one defines the word ‘marriage’…

Sheikh Fehmi’s comment on polygamy in the above report is somewhat different to what he told the ABC’s Compass program back on 6 May 2001:

Narrator: “... Islam recognises polygamy so prior to 1968 Imams like Sheikh Fehmi were not permitted to celebrate marriages.

Sheikh Fehmi : “It used to be at the time the late Mr Snedden he was the Attorney General. So I had a good meeting with him one day and tried to convince him that it is important for the Muslim to marry their own people. But he used to say to me. Well you know Sheikh Fehmi that you Muslims may marry more than one and when we are not allowed to let anybody here for have only one wife. I said to him, listen to me please you may register the first one and don’t worry about the second one. He laughed and said all right we won’t have anything to do with the second one. I stopped at the idea and at the time we had gained recognition from the Attorney General for all our Imams around Australia from that year onward.” (2) [emphasis added]

Following the report in The Age on Friday morning, 21 November, Sheikh Femhi was interviewed on the ABC 7pm News that evening. (3)

During the interview he endorsed polygamy. Although he apparently said it was uncommon and difficult, Sheikh Fehmi said in “some circumstances you may be able to have another wife”. Those circumstances included when the “wife is unable to carry out her duties for her husband”.

Australia’s highest Muslim authority has defended the practice of polygamy.

ABC News, Fri Nov 21, 2008 7:04pm

In a detailed interview following these initial reports, Sheik Fehmi responded to the complaints of the women. He said “It is good to hear the complaints of the sisters, and to try to find some solution to their concerns.” (4)

In response to criticism of mosque facilities, he offered to try and organise to allow men and women to pray together in mosques.

He acknowledged that there may be problems with some imams. He said:

* On domestic violence, imams taught that men should never strike their wives. “The prophet said, ‘I never hit a wife in my life’, and everybody should do the same.”

- BUT what about the Qur’an verse that says men may beat their wives? See Sura 4:34

*On polygamy, he said Islam allowed a second wife only if the husband guaranteed he could treat both exactly alike, which almost amounted to a prohibition. “Polygamy in Islam is not willy-nilly. There are a lot of restrictions, which sometimes make it impossible.

But that means it is sometimes possible!

* On rape within marriage, he said the solution was to link legal divorce with Islamic divorce — something the board was working towards.

SOME Muslim religious leaders in Victoria are condoning rape within marriage, domestic violence, polygamy, welfare fraud and exploitation of women, according to an explosive report on the training of imams.

- Rape and violence condoned within marriage: report
- Study says Islamic law applied to benefit men
- Mufti of Australia denies claims

The report says some imams apply Sharia (Islamic law) when it benefits men but not when it benefits women, and that they hinder police from pursuing domestic violence charges.

Women seeking divorces have also been told by imams that they must leave “with only the clothes on their back” and not seek support or a share of property because they can get welfare payments.

And the report says some imams knowingly perform polygamous marriages, also knowing that the second wife, a de facto under Australian law, can claim Centrelink payments.

The report is based on a study commissioned and funded by the former Howard government and conducted by the Islamic Women’s Welfare Council of Victoria.

It was presented yesterday at a National Centre for Excellence in Islamic Studies conference at Melbourne University.

It is the result of extensive community consultation, interviews with police, lawyers, court workers and academics, and meetings with and questions to the Victorian Board of Imams.

The board’s role is to provide an Islamic view and religious guidance to the community and represent it to the media. The report claims that the 24-man board ignored or did not directly answer many of the questions.

It says women, community and legal workers and police involved in the consultation were particularly concerned about domestic violence, and suggested that imams aimed to preserve the family at the cost of women.

When cases came to court they were often dropped after family and community elders pressured women to withdraw charges.

The report says some women who were legally separated but not religiously divorced had their husbands enter their houses, demand sexual intercourse and take it by force.

“Workers who have assisted women in this situation said that the advice women received from the imams was that it was “halal” — permitted — because there was a valid “nikah” — marriage,” it says.

The report also cites sexual assault allegations connected with under-age marriages.

It says polygamy is steadily increasing and gaining acceptance among Melbourne Muslims, and Shepparton police report many “de facto” relationships that are really polygamous marriages.

“Community workers who have provided support to women whose husbands took another wife religiously said that women blame the availability of Centrelink benefits … since one or the other wife will be claiming it, relieving the husband of the responsibility of supporting two families,” the report says.

Community members quoted in the report believe that imams’ narrow religious training in an increasingly complex world, lack of life experience, poor English and lack of understanding of Australia create problems for the community. For example, ill-informed comment by imams drew a wedge between the mainstream and Muslim communities.

The report suggests the Muslim community believes many imams are ill-equipped for the role, which involves much higher expectations in Australia than in predominantly Muslim countries, including marriage counselling, pastoral and spiritual care, marriages and divorces.

“They come from their own little village and culture and say this is what Islam is,” one woman is quoted saying. “They come from a village where there is no running water and electricity, and they bring their dark ideas into this country.”

The secretary of the Board of Imams, Sheikh Fehmi Naji El-Imam, said he could not understand how the council could write such a report and denied the complaints “absolutely”.

Islamic women’s council chairwoman Tasneem Chopra said: “We are hoping we can negotiate with the appropriate authorities a better outcome for women, whether through law reform or education.

“This is a crucial, necessary beginning but it is part of a much larger picture.”
