Greek Orthodox leaders trying to rebuild the only church destroyed in the Sept. 11 terror attacks expressed shock this week after learning, via Fox News, that government officials had killed a deal to relocate the church.

The St. Nicholas Greek Orthodox Church, once a tiny, four-story building in the shadows of lower Manhattan, was destroyed in 2001 by one of the falling World Trade Center towers. Nobody from the church was hurt in the attack, but the congregation has, for the past eight years, been trying to rebuild its house of worship.

Though talks between the church and the Port Authority of New York and New Jersey stalled last year, church leaders say they’ve been trying to kick-start discussions ever since. But amid debate over whether a proposed Islamic community center should go forward near Ground Zero, government officials threw cold water on the prospect of any deal with the church — telling Fox News the deal is off the table.

Confronted with the Port Authority’s verdict, Father Mark Arey, of the Greek Orthodox Archdiocese of America, said it’s the first he’s heard that.

“Negotiations did break off last year. We were expecting to hear from their lawyers — we never did. We’re still expecting to hear from them,” he told Fox News. “We’re disappointed. … 130 Liberty Street was promised to us.” (More from FoxNews)

The Status of Non-Muslims Under Muslim Rule

After the rapid expansion of the Muslim dominion in the 7th century, Muslims leaders were required to work out a way of dealing with Non-Muslims, who remained in the majority in many areas for centuries. The solution was to develop the notion of the “dhimma”, or “protected person”. The Dhimmis were required to pay an extra tax, but usually they were unmolested. This compares well with the treatment meted out to non-Christians in Christian Europe. The Pact of Umar is supposed to have been the peace accord offered by the Caliph Umar to the Christians of Syria, a “pact” which formed the pattern of later interaction.

We heard from ‘Abd al-Rahman ibn Ghanam [died 78/697] as follows: When Umar ibn al-Khattab, may God be pleased with him, accorded a peace to the Christians of Syria, we wrote to him as follows:

In the name of God, the Merciful and Compassionate. This is a letter to the servant of God Umar [ibn al-Khattab], Commander of the Faithful, from the Christians of such-and-such a city. When you came against us, we asked you for safe-conduct (aman) for ourselves, our descendants, our property, and the people of our community, and we undertook the following obligations toward you:

We shall not build, in our cities or in their neighborhood, new monasteries, Churches, convents, or monks’ cells, nor shall we repair, by day or by night, such of them as fall in ruins or are situated in the quarters of the Muslims.
We shall keep our gates wide open for passersby and travelers. We shall give board and lodging to all Muslims who pass our way for three days.
We shall not give shelter in our churches or in our dwellings to any spy, nor bide him from the Muslims.
We shall not teach the Qur’an to our children.
We shall not manifest our religion publicly nor convert anyone to it. We shall not prevent any of our kin from entering Islam if they wish it.
We shall show respect toward the Muslims, and we shall rise from our seats when they wish to sit.
We shall not seek to resemble the Muslims by imitating any of their garments, the qalansuwa, the turban, footwear, or the parting of the hair. We shall not speak as they do, nor shall we adopt their kunyas.
We shall not mount on saddles, nor shall we gird swords nor bear any kind of arms nor carry them on our- persons.
We shall not engrave Arabic inscriptions on our seals.
We shall not sell fermented drinks.
We shall clip the fronts of our heads.
We shall always dress in the same way wherever we may be, and we shall bind the zunar round our waists
We shall not display our crosses or our books in the roads or markets of the Muslims. We shall use only clappers in our churches very softly. We shall not raise our voices when following our dead. We shall not show lights on any of the roads of the Muslims or in their markets. We shall not bury our dead near the Muslims.
We shall not take slaves who have been allotted to Muslims.
We shall not build houses overtopping the houses of the Muslims.
(When I brought the letter to Umar, may God be pleased with him, he added, “We shall not strike a Muslim.”)

We accept these conditions for ourselves and for the people of our community, and in return we receive safe-conduct.

If we in any way violate these undertakings for which we ourselves stand surety, we forfeit our covenant [dhimma], and we become liable to the penalties for contumacy and sedition.

Umar ibn al-Khittab replied: Sign what they ask, but add two clauses and impose them in addition to those which they have undertaken. They are: “They shall not buy anyone made prisoner by the Muslims,” and “Whoever strikes a Muslim with deliberate intent shall forfeit the protection of this pact.”

Feisal Abdul Rauf (ECTN) Jihadwatch

Feisal Abdul Rauf, a New York imam, expects us to believe that jihad warfare was started by the West and can only be ended by the West. He is therefore either concealing or ignorant of the fact that violent jihad is a developed tradition within Islam and found in core Islamic texts (including but not limited to the Qur’an, as well as Hadith and books of Islamic jurisprudence). In those it has nothing to do with the behavior of infidels. It only has to do with the fact that they are infidels. Take, for example, this quotation from the Muslim prophet Muhammad:

When you meet your enemies who are polytheists, invite them to three courses of action. If they respond to any one of these, you also accept it and withold yourself from doing them any harm. Invite them to (accept) Islam; if they respond to you, accept it from them and desist from fighting against them. . . . If they refuse to accept Islam, demand from them the Jizya. If they agree to pay, accept it from them and hold off your hands. If they refuse to pay the tax, seek Allah’s help and fight them. (Sahih Muslim, book 019, Number 4294)

That is offensive jihad. It is buttressed by numerous other sayings of the Prophet, by the Qur’an, and by Islamic legal scholars. But Feisal Abdul Rauf puts it all on the West, and gets invited to Australia by Premier Bob Carr.

Speaking from his New York mosque, Imam Feisal said the West had to understand the terrorists’ point of view.

In a move likely to cause controversy with church leaders, Imam Feisal said it was Christians who started mass attacks on civilians.

“The Islamic method of waging war is not to kill innocent civilians. But it was Christians in World War II who bombed civilians in Dresden and Hiroshima, neither of which were military targets.”

This Islamo-turd does not speak for Germans and he has no mandate to speak for Japanese. Besides, what is the price of goat-meat in Timbuktu?

This is outrageously specious, but it depends on the ignorance of the listeners. The bombings of Dresden and Hiroshima were not justified by the bombers on the basis of Christian theology. The bombings by terrorists — 9/11, 3/11, etc. — are justified on the basis of Islamic theology. By claiming that they are equivalent, Abdul Rauf obscures the Islamic roots of modern-day terrorism, thus hindering the prospects for the reform within Islam that is so desperately needed if jihad terrorism is ever going to cease.

Islam is perfect. It  cannot be reformed.

Imam Feisal said the bombing in Madrid had made his message more urgent. He said there was an endless supply of angry young Muslim rebels prepared to die for their cause and there was no sign of the attacks ending unless there was a fundamental change in the world.

Yes indeed. But displaying a lack of the self-critical faculty that he shares with radical Muslims, he makes no mention, at least according to this report, of the Islamic roots of terror, and of the need for Muslims who truly (rather than deceptively) oppose terror to address this problem.

Where are they? Met any lately?

Imam Feisal, who argues for a Western style of Islam that promotes democracy and tolerance, said there could be little progress until the US acknowledged backing dictators and the US President gave an “America Culpa” speech to the Muslim world.

“Western style of Islam that promotes democracy and tolerance?” Imam Feisal will die and kill to make Islam the dominant religion. Islam doesn’t know any concept of “innocent, democracy or tolerance”.  Take your taqiyya and rub it, imam!

You still have doubts? I have no doubts that allowing Muslims into Sweden will be a terrific expense, that these Muslims cannot possibly integrate, and what they will take out of the system, making sure they receiveevery possible benefit, part of a welfare system that is amazingly generous (and naive), one that was originally created by Swedish voters and taxpayers, for the intended benefit of other Swedes, but now being exploited by Muslim immigrants whose hatred of bid’a (innovation, that is any new or entrepreneurial acitvity on their own part) and their deep inshallah-fatalism, guarantees they will economically fall immediately behind, so that they will always havee far higher rates of employment.

Meanwhile, their wives, one or more, will breed and breed and breed, as Oriana Fallaci famously warned, and you have only to look at the figures about Muslim population growth, all over Western Europe, to see what is going on.

Muslim immigration has to be halted, and then reversed. This can be done, just. But the countries of Western Europe have to turn off the tap, and make their own lands as unwelcome and hostile to Islam, to its practice, and to its adherents (the fact that a handful, in the mental freedom of the West, jettison Islam and so can fit in, is no consolation).

Car bomb in Times Square near Comedy Central

Even Janet Napolitano is saying that the car bomb defused in Times Square last night was a “potential terrorist attack.” One wonders what “three propane tanks, consumer-grade fireworks, two filled 5-gallon gasoline containers, and two clocks with batteries, electrical wire and other components” could be other than a terrorist attack, but I leave that to the learned analysts.

In any case, we know that when Napolitano thinks “terrorist” she doesn’t think “Islamic jihadist” but rather “right-wing extremist,” so even if this was an attempted Islamic jihad attack, it might take DHS awhile to find that out, and the mainstream media awhile to report it. But one clue comes from Jihad Watch reader Michael M.: “the vehicle was parked on 45th Street between 7th and 8th avenues in New York City. This is the location of VIACOM, Inc. offices. VIACOM owns Comedy Central. Comedy Central as we all know is the home of ‘South Park’. This information is omitted from every article I’ve come across so far.”

Coincidence. Not.

But the detractors are working overtime, already:

Three heroic cops and a quick-thinking street vendor stopped a madman from detonating a car bomb in the heart of Times Square Saturday night, law enforcement officials told the Daily News.

The T-shirt vendor – a Vietnam vet – told Officer Wayne Rhatigan there was smoke coming from a Nissan SUV on the southwest corner of 45th St. and Broadway about 7 p.m., sources said.

Rhatigan approached the car, saw the smoke, and sprang into action.

“I did a lap around the vehicle. The inside was smoking,” Rhatigan told the Daily News Saturday night. “I smelled gunpowder and knew it might blow. I thought it might blow any second.”

He grabbed two rookie female cops patrolling the area. Together, they pushed hundreds of people away from the scene as they called for backup, he said.

The Fire Department and bomb squad rushed to the scene.

What they found was stunning: a running SUV packed with three propane tanks, two red 5-gallon plastic jugs of gasoline, a clock, electrical components and a canister of gunpowder, police sources said.

“We are very lucky,” Mayor Bloomberg said at an early morning press conference at the scene, still wearing a tuxedo and red bow tie. “Thanks to alert New Yorkers and professional police officers we avoided what could have been a very deadly event.”

The two rookie cops reported seeing a man running away from the scene as they approached the car.

Police spokesman Paul Browne said cops were investigating a report that someone was seen running from the vehicle at some point and are reviewing security videotapes.

“It looks as if the perp was trying to light it up, and was interrupted by the cops, panicked and took off,” a law enforcement source said. [...]

Cops closed a huge chunk of Times Square from 43rd St. to 49th Sts. on Seventh Ave. and all of 45th St. from Seventh Ave. to Eighth Ave.

They were pulling video footage from a number of security cameras in the area.

Times Square had been jammed with pedestrians all day.

Celebrities Halle Berry, Jessica Biel and Jessica Alba and thousands of women ran through Times Square in the afternoon for the EIF Revlon Run/Walk, which raises money for research to fight ovarian cancer.

Now there’s a contrast of priorities.

“The death toll could have been enormous,” a police source said. “It was a nice day and the Times Square area was completely packed.”

The tenant who occupies his townhouse in Flushing, Queens, described Hasanoff as a polite family man who, like his wife Wahida, is heavily into fundamentalist Islam.

“She’s very religious and her husband is too,” Fahima Rustam told News Limited at the neat split-level home yesterday.

Family’s shock at al-Qaeda arrest

THE Melbourne sister-in-law of an Australian facing terrorist charges in the United States for allegedly helping to ”modernise” al-Qaeda said she was shocked to hear of his arrest.

New York-based Sabirhan ”Tareq” Hasanoff, 34, who has both Australian and US citizenship, was one of two men charged with conspiring to supply material support to al-Qaeda.

Hadicha Hasanoff, who lives in Meadow Heights and is married to Sabirhan’s brother, Alimhan, said Sabirhan had grown up in Adelaide.

An indictment filed against Hasanoff and Wesam El-Hanafi alleged they had ”engaged in planning and perpetrating a federal crime of terrorism against the United States”.

Mrs Hasanoff said she and her husband had not seen Sabirhan for more than 12 years. He had moved to America many years ago and they lost contact.

When told Sabirhan had been arrested and accused of links to al-Qaeda, Mrs Hasanoff said: ”Big shock, big shock.”

”No, he never in trouble.

”I don’t know what’s happened now. He study at private school, maybe he change. I don’t know if he good person, bad person, because we not connected now long time.”  (Gee, and Willie Clitman is still running around telling us that poverty causes terrorism/ed)

Mrs Hasanoff said she did not know anything about reports that Sabirhan was a devoted follower of fundamentalist Islam.

US authorities said Sabirhan Hasanoff and Wesam ”Khaled” El-Hanafi, 33, had been arrested at an undisclosed location overseas and flown to the US before their court appearance in Virginia on Friday. They each faced one count of conspiring with al-Qaeda between November 2007 and March 2010 and face up to 15 years’ jail if convicted.

In court on Friday, both men waived their rights to a hearing and were ordered to be transferred in custody to New York for a bail hearing.

An indictment unsealed in the Federal Court in Manhattan claimed Hasanoff, who was a senior accountant with Price-waterhouse Coopers in New York from 2003 to 2006, had been paid $US50,000 in November 2007 by an unnamed co-conspirator before travelling to New York City nine months later to ”perform tasks for al-Qaeda”. The details of the tasks were not outlined in the indictment.

In July last year, El-Hanafi and Hasanoff were alleged to have discussed with the co-conspirator ”seeking out additional contacts with al-Qaeda”.

Public records showed Hasanoff lived in Brooklyn with his wife, Wahida, and the couple’s two young children and was a certified public accountant. (They make good money, those certified public accountants/ed)

US Attorney Preet Bharara said in a statement that El-Hanafi and Hasanoff had schemed ”to modernise al-Qaeda by providing computer systems expertise and other goods and services”. His office declined further comment.

The Left gets its reckoning.

The decision to bring Khalid Sheikh Mohammed and four other top al-Qaeda terrorists to New York City for a civilian trial is one of the most irresponsible ever made by a presidential administration. That it is motivated by politics could not be more obvious. That it spells unprecedented danger for our security will soon become obvious.

The five 9/11 plotters were originally charged in a military commission. Military commissions have been approved by Congress and the courts. Eleven months ago, the jihadists were prepared to end the military case by pleading guilty and proceeding to execution. Plus, the Obama administration is continuing the commission system for other enemy combatants accused of war crimes. If we are going to have military commissions for any war criminals, it is senseless not to have them for the worst war criminals. In sum, there is no good legal or policy rationale for transferring these barbarians to the civilian justice system. Doing so will prompt a hugely costly three-ring circus of a trial, provide a soapbox for al-Qaeda’s anti-American bile, and create a public-safety nightmare for New York City.

There is, however, a patent political rationale behind Obama’s decision.

The terrorists are clearly committed members of the al-Qaeda conspiracy to wage a terrorist war against the United States — so much so that KSM cannot help himself, bragging about his atrocities against our country, including the 9/11 massacre of nearly 3,000 Americans. Further, controversy surrounds the intelligence-collection measures used by the Bush administration after 9/11 — measures such as enhanced interrogation that, though they saved countless lives, have been stridently condemned by the antiwar Left. This antiwar Left, President Obama’s base, has demanded investigations and prosecutions against Bush officials.

The Obama Justice Department teems with experienced defense lawyers, many of whom (themselves personally or through their firms) spent the last eight years volunteering their services to America’s enemies in their lawsuits against the American people. As experienced defense lawyers well know, when there is no mystery about whether the defendants have committed the charged offenses, and when there is controversy attendant to the government’s investigative tactics, the standard defense strategy is to put the government on trial.

That is, Pres. Barack Obama and Attorney General Eric Holder, experienced litigators, fully realize that in civilian court, the Qaeda quintet can and will demand discovery of mountains of government intelligence. They will demand disclosures about investigative tactics; the methods and sources by which intelligence has been obtained; the witnesses from the intelligence community, the military, and law enforcement who interrogated witnesses, conducted searches, secretly intercepted enemy communications, and employed other investigative techniques. They will attempt to compel testimony from officials who formulated U.S. counterterrorism strategy, in addition to U.S. and foreign intelligence officers. As civilian “defendants,” these war criminals will put Bush-era counterterrorism tactics under the brightest public spotlight in American legal history.

This is exactly what President Obama and Attorney General Eric Holder know will happen. And because it is unnecessary to have this civilian trial at all, one must conclude that this is exactly what Obama and Holder want to see happen.

During the 2008 campaign, candidate Obama and his adviser, Holder, rebuked the Bush counterterrorism policies and promised their base a “reckoning.” Since President Obama took office, Attorney General Holder has anxiously shoveled into the public domain classified information relating to those policies — with the administration always at pains to claim that its hand is being forced by court orders, even though the president has had legal grounds, which he has refrained from invoking, to decline to make those disclosures. Moreover, during a trip to Germany in April, Holder signaled his openness to turning over evidence that would assist European investigations — including one underway in Spain — that seek to charge Bush-administration officials with war crimes (which is the transnational Left’s label for actions taken in defense of the United States).

Now, we see the reckoning: Obama’s gratuitous transfer of alien war criminals from a military court, where they were on the verge of ending the proceedings, to the civilian justice system, where they will be given the same rights and privileges as the American citizens they are pledged to kill. This will give the hard Left its promised feast. Its shock troops, such as the Center for Constitutional Rights, will gather up each new disclosure and add it to the purported war-crimes case they are urging foreign courts to bring against President Bush, his subordinates, and U.S. intelligence agents.

From indictment to trial, the civilian case against the 9/11 terrorists will be a years-long seminar, enabling al-Qaeda and its jihadist allies to learn much of what we know and, more important, the methods and sources by which we come to know it. But that is not the half of it. By moving the case to civilian court, the president and his attorney general have laid the groundwork for an unprecedented surrender of our national-defense secrets directly to our most committed enemies.

The five jihadists in question are alien enemy combatants currently detained outside the United States. They are not Americans and are not entitled to the protection of our Bill of Rights. That means that in a military-commission trial, they would be given only those rights Congress chose to give them.

At Gitmo, they’ve insisted on representing themselves. In a military commission, we can allow them to do that, but we don’t have to. The commission rules provide for the appointment of military counsel and permit the combatants to retain their own lawyers. This is significant because discovery rules require that the defense be given mounds of information for trial preparation. Much of that information is top-secret intelligence. Importantly, however, we do not have to show the terrorists themselves any classified information. Only counsel who have the required security clearances, and are duty-bound not to reveal the nation’s secrets to the nation’s enemies, get access.

The rules are saliently different in the civilian justice system, where, the attorney general has promised, this case will be treated like any other criminal case. In federal court, defendants — even illegal aliens — are vested with constitutional rights that Congress may not alter or reduce. One of those is the right to represent oneself, meaning: to conduct one’s own defense without the participation or interference of an attorney.

In 1975, the Supreme Court ruled in Faretta v. California that this right to self-representation is absolute. As Justice Potter Stewart put it, “forcing a lawyer upon an unwilling defendant is contrary to his basic right to defend himself if he truly wants to do so.” To borrow Holder’s pet phrase, we are supposedly bringing terrorists into civilian court to honor “the rule of law.” Well, our rule of law holds that a defendant may tell the judge that he does not want a lawyer, that he wants to conduct his own defense, and that he wants to see all of the legally required discovery himself — not have a lawyer or some other government operative restrict his access.

The judge may try to talk the defendant out of his decision to be his own lawyer. The judge may appoint “stand-by counsel” to advise the defendant and to be available to represent the defendant if he changes his mind. Under Faretta, however, the judge may not deny the defendant the right to conduct his own defense.

By transferring this case to civilian court rather than leaving it to be handled by the military-commission system created by Congress, Obama and Holder have needlessly created a perilous dilemma. Do we deny KSM & Co. the right to represent themselves and thus risk reversal of any convictions on Sixth Amendment grounds? Do we grant them self-representation but withhold critical discovery and thus risk reversal on due process grounds? Or do we grant them self-representation and disclose directly to our wartime enemies the nation’s security secrets, which they can then pass on to confederates who are actively targeting us for mass-murder attacks?

In the military court, there would be no such dilemma. Indeed, in the military court, this case would be over now. If President Obama had simply let it proceed, there would have been no trial, and these war criminals would be well on their way to the execution of death sentences.

But then the Left would not have gotten its reckoning. Can’t have that.

The lovely-looking restaurant and bar The Breslin begins lunch service tomorrow, and co-owner Ken Friedman (The Spotted Pig) is planning on serving alcohol despite objections from the Masjid Ar-Rahman mosque across the street. Earlier this month the mosque’s leaders called a meeting with Friedman at The Ace Hotel, where The Breslin is located, and asked, “Can you move the bar?” Friedman’s response makes us want to hurry over to The Breslin right now for a dram of Laphroaig to show our support (and drown out the voices):

I laughed. And the guy said, “Oh, you think that’s funny?” And I said, “Yeah, that is funny, that is really funny, because we’re not going to move the bar just because you discovered we’re serving booze.” Can you name one restaurant in New York that doesn’t serve booze? I said, “This is the United States of America and we’ll do whatever the fuck we want.” He said the mosque had suggested it couldn’t control the behavior of “a few bad eggs”; i.e., we could get a brick through our window.

Friedman notified police of the threat, but just to show he’s not a hard-hearted man, that it’s not all dollars and cents, he agreed to put a curtain over the windows so devout Muslims wouldn’t be corrupted by the sight of infidel inebriation. But the curtain hasn’t arrived yet, so over the weekend he actually taped paper over the windows to hide a gay wedding. A volunteer at the mosque says city law forbids serving liquor within 200 feet of a place of worship and that “not more than 200 feet is between the mosque and the bar.”

But Ace Hotel developer Andrew Zobler tells The Observer, “The law is clear that in order for that to apply it has to be an exclusively dedicated house of worship, and at their space they have both residences and a restaurant, so basically, because of those uses the law allowed there to be a bar within 200 feet. Everyone was aware of that when the liquor license was granted.” And Friedman adds, “They can threaten, but they can’t really stop us.” Yeah, heh, what are these devout, pissed-off Muslims gonna do?

The real question is: will free speech be put behind bars? And the larger question for the West is: will we leave Europe’s children the values of Rome, Athens and Jerusalem, or the values of Mecca Teheran, and Gaza?Hate speech will always be used against the people defending the West-in order to please and appease Muslims. They can say whatever they want: throw gays from apartment buildings, kill the Jews, slaughter the infidel, destroy Israel, jihad against the West. Whatever their book tells them.

…My prosecution is a full-fledged attack by the Left on freedom of speech in order to please Muslims.

I propose the withdrawal of all hate speech legislation in Europe….In Europe, we should defend freedom of speech like Americans do….Millions think liberty is precious. That democracy is better than Shariah….there is no stronger power than the force of free men fighting for the great cause of liberty.

 

In welcoming Mr. Wilders to America, Frank Gaffney, President of the Center for Security Policy, observed that the threats he faces are actually threats to all of us. They arise from the theo-political-legal program authoritative Islam calls “Shariah”: Mr. Gaffney observed that:

The insinuation of Shariah legal codes and practices into Free World societies includes the effort to impose Shariah blasphemy, slander and libel laws in the West. According to Shariah, it is impermissible to engage in speech or writings that ‘defame’ Islam or otherwise offend its followers. We must oppose all these efforts.

Lars Hedegaard, President of the International Free Press Society, introduced Wilders and outlined the IFPS 2009 campaign to ban hate speech laws and to work for an “International First Amendment.” Mr. Hedegaard said:

The hate speech and blasphemy laws that are now common in many European countries lack clarity as to precisely what they aim to criminalize. Recent experience with their implementation further shows that they are unequally applied. This state of affairs is intolerable and the IFPS must therefore demand that all such laws be repealed. The way to deal with controversial, offensive or even hateful statements-unless they are directed to inciting or producing imminent lawless action-is to expose them to public debate and criticism.
