A Swedish appeals court has sparked nationwide outrage after ruling that an 18-year-old Eritrean migrant who raped a 16-year-old girl will not be deported — because, in the court’s words, “the duration of the rape” was not long enough to qualify as an “exceptionally serious offense.”
The victim, 16-year-old Meya Åberg, was attacked on the night of September 1st last year after she missed her bus home from work. While walking through a pedestrian tunnel after her shift at McDonald’s, she was assaulted by Yazied Mohamed, an Eritrean national with refugee status in Sweden.
Meya and her family immediately reported the assault to police, and Mohamed was later convicted of rape and sentenced to three years in prison. Prosecutors also sought to have him deported, noting that he is not a Swedish citizen.
But the Court of Appeal for Upper Norrland rejected that request — citing Sweden’s refugee-protection laws. Under current Swedish statutes, a refugee may only be deported if the crime is deemed “exceptionally serious” and if allowing the person to stay would pose a “serious threat to public order and safety.”
The court concluded that, while the rape was indeed serious, it did not meet that threshold — citing, among other factors, its “duration.”
“Rape is, in many cases, considered an exceptionally serious offense that could lead to deportation of a refugee,” the court wrote. “But an assessment must be made based on all circumstances in the individual case. Given the nature and duration of the offense in question, the Court of Appeal finds that while the crime is serious, it does not constitute an exceptionally serious offense that would warrant a deportation order for Yazied Mohamed.”
The decision has ignited public fury across Sweden and beyond — with critics calling it a disturbing symbol of how lenient Europe’s migration and justice systems have become.
