‘The Treaty of Tripoli’ has nothing to do with the constitution. Its was a  diplomatic document to appease the savage Bey of  Tripoli who’s pirates (“privateers”)  used to raid our ships. The treaty was a routine diplomatic agreement but has attracted later attention because the English version included a clause about religion in the United States.
