Kirby’s law, update:

A new book analysing the career of the Left’s favorite judge, High Court Justice Michael Kirby, gives plenty of reason to suspect this is a man who let his political biases overwhelm his duty to administer the law:

By 2007, some 48 per cent of his decisions rendered Kirby in the minority on the court, a rate that increased after 2007. Some might see this as a marker of Kirby’s libertarian stance on certain issues. Others might argue it was the result of occasionally, though not always, being too keen to achieve a particular outcome; perhaps his desire for the goal overwhelmed the brilliance and rigour of research and analysis.

Which seems to me a polite way of saying he made stuff up to suit his agenda. No wonder the Left loved him, little caring that democracy demands that unelected judges administer the people’s laws, not impose their own. And no wonder that this attention seeker left many fellow judges cold: 

His former High Court colleague Mary Gaudron recently… suggested Kirby was not the first person fellow judges would tap to write the lead opinion when it came to the weighty task of publishing reasons for judgement. Gaudron was intimating something about the man himself, perhaps making an observation about his brittle relationship with some High Court colleagues in latter years.

Yet as some contributors note in Appealing to the Future, for all Kirby’s rigorous research into cases he tackled, occasionally his train of reasoning jumped the tracks. Ian Freckelton writes that Kirby occasionally fell back on “diffuse and nebulous sources such as common sense, common experience or intuition”. He says: “It tends to happen when he feels either constrained by a pre-existing rule, precedent and legislation, or is particularly troubled by an identified injustice.”

Again, another polite way to say that he tried to make up his own laws when the voters’ laws didn’t suit him.

The following story about a rape in the South Station of Brussels was translated on the Gates of Vienna blog from La Dernière Heure. I bring here another translation from a Dutch newspaper, together with several related items about the situation of women in the area.

A 21 year old woman was pushed against an ATM machine in the Brussels South station by two young men and raped last week. According to the victim, at least three travelers passed by, but nobody tried to help her.

Around 9pm Lola arrived at the South station in a train from Waterloo. She walked over to an ATM when suddenly tow you men asked her in a threatening tone why she didn’t wear a headscarf as she should.

“You must know: my daughter has blond hair and blue eyes, that is wholly not a North-African appearance. It was the way of those two men simply to intimidate her, so that it would be easier for them to then abuse her,” says Marc, Lola’s father.

And that is what sadly occurred. One of the men took out a knife and pushed the blade against the throat. Then he pushed the young woman against the wall and raped her while his friend looked on and watched that nobody would dare interfere.

“Nobody had the courage to save my daughter out of the clutches of the duo,” continued father Marc with rage. “According to Lola nonetheless certainly three men passed by, but nobody even got ready to stop. At 9pm at this time of year it’s still far from dark and the South Station is is certainly not yet abandoned. Why did everybody leave my daughter to her fate?”

The brutal assault on his daughter reminds Marc as well of the murder of Joe Van Holsbeeck, the youth who was stabbed to death in the Brussels Central Station in order to steal his MP3 player. “That also happened while travelers passed by. Also then nobody thought it necessary to help the victim. I think it’s revolting. And I point an accusing finger at the Belgian government, who does nothing to prevent such dramas.

It would go against Denmark’s international obligations if the two Tunisian men accused of planning to murder Kurt Westergaard were deported, according to a new report by human rights organisation Amnesty International.

The two Tunisian men face an administrative deportation to their home country after they allegedly planned to murder the cartoonist behind the Mohammed drawings. The administrative deportation should mean that they will not be at risk of torture in Tunisia, but Amnesty’s new report says otherwise.

Amnesty documents hundreds of cases of torture and abuse in its new report ‘In the name of security: Routine abuses in Tunisia’. It says that at least 977 Tunisians have been sentenced under anti-terror laws since 2006. It also says that many civilians have been sentenced in military courts with a minimum amount of evidence.
A letter from Amnesty International was sent to the Danish Justice Ministry last week warning the government not to compromise the UN Convention against Torture and violate human rights by sending the men to a country that routinely ignores its promises to treat returned deportees fairly.
‘It is clear to anybody that it is completely irresponsible to deport the Tunisian citizens under the current circumstances, where there is an impending risk of torture and abuse,’ said Eva Hesse of the Danish branch of Amnesty. (kr)

Employees removed a crucifix in a room at the Catholic clinic Saint-Vincent de Paul in Bourgoin-Jallieu after the Muslim father of a patient demanded they do so before treating his daughter.

Marie-Therese Besson, manager of the clinic, says that people who choose to be treated at the clinic know that they are a Catholic establishment.  It says so clearly at the entrance and the nurses wear a Catholic habit.  She adds that there is a small crucifix in every room.  In this incident the nurse did what was necessary to calm down the situation.

The Saint Vincent de Paul Bourgoin-Jallieu clinic is part of l’Alliance des maternités catholiques. Sister Marie-Mathieu, head of the board of directors for l’Alliance des maternités catholiques, says the issue will be brought up in the next meeting of the ethics committee.  She say that they occasionally face such situations in their institutions, the last time being several months ago when a father broke a crucifix in a clinic in Aix-en-Provence and threw it in the trash.  That incident was not tolerated.

 

The administration says that they regularly treat Muslim women and respect their wish to be veiled.  Sister Marie-Mathieu says that such incidents go against the basic tenant of mutual respect.

Danish Muslims Take Prophet Cartoons to EU Court

COPENHAGEN — Danish Muslims are planning to take Denmark’s Jyllands-Posten daily to Europe’s highest human rights court over the publication of satirical drawings of Prophet Muhammad (peace and blessing be upon him).
“[Danish] Muslim organizations intend to take the case to the European Court of Human Rights,” Muslim leader Mohammed Khalid Samha told IslamOnline.net on Friday, June 20.

The move comes a day after a Danish court rejected a suit by seven Muslim groups against newspaper editors for publishing the offensive cartoons.

“We were quite sure that the Danish judiciary would not be fair to Muslims,” said Samha.

This is one thing, while consummating the marriage – having sex with the wife for the first time – is another thing. There is no minimal age for entering marriage. You can have a marriage contract even with a one-year-old girl, not to mention a girl of nine, seven, or eight. This is merely a contract [indicating] consent. The guardian in such a case must be the father, because the father’s opinion is obligatory. Thus, the girl becomes a wife… But is the girl ready for sex or not? What is the appropriate age for having sex for the first time? This varies according to environment and traditions. In Yemen, girls are married off at nine, ten, eleven, eight, or thirteen, while in other countries, they are married off at 16. Some countries have legislated laws forbidding having sex before the girl is eighteen.

Sheikh Khalil Chami of the Islamic Welfare Centre in Lakemba today said polygamous marriages, although illegal, existed in Australia and should be recognised.

China demolishes mosque over Olympic row

BEIJING: Chinese authorities in Xinjiang have demolished a mosque for refusing to put up signs in support of this August’s Beijing Olympics, an exiled group said on Monday. 

The mosque was in Kalpin county near Aksu city in Xinjiang’s rugged southwest, the World Uyghur Congress said. 

“China is forcing mosques in East Turkistan to publicise the Beijing Olympics to get the Uighur people to support the Games (but) this has been resisted by the Uighurs,” World Uyghur Congress spokesman Dilxat Raxit said in an email.

Beijing says al-Qaida is working with militants in Xinjiang to use terror to establish an independent state called East Turkistan. Oil-rich Xinjiang is home to 8 million Turkic-speaking Uighurs, many of whom resent the growing economic and cultural influence of the Han Chinese. 

Dilxat Raxit added that the mosque, which had been renovated in 1998, was accused of illegally renovating the structure, carrying out illegal religious activities and illegally storing copies of the Muslim holy book the Koran.
