The pretrial conference in the Flying Imams case took place by telephone on February 5. Again, I’m not legally literate, but I grasp that the purpose of the pretrial conference is set up ground rules for the damages involved, the amount and scope of discovery, the rummaging of each side through the other side’s business, and the time frame for when discovery finishes and when the actual trial starts.

It seemed pretty much like boiler-plate until it got to the alleged damages. It started with Ahmed Shqeirat:

Ahmed Shqeirat: Plaintiff Shqeirat has suffered intangible losses including pain, suffering, loss of liberty, loss of enjoyment of life, emotional distress, humiliation, and the like. Because the damages are intangible, it is difficult to itemize the dollar amount of each element of the alleged damages. Plaintiff estimates the dollar amount of his damages to be well in excess of $100,000.

[So that’s well in excess $100,000 in intangible damages. We haven’t gotten to the tangible damages yet.]

Mr. Shqeirat’s tangible damages include expenses incurred as a result of the inconvenience of traveling on airlines other than US Airways.

[It should be noted that Mr. Shqeirat, or any of the other imams, are permitted to fly on US Airways, so the inconvenience is purely manufactured.]

Additionally, Plaintiff has incurred expenses in time and money caused by increased scrutiny by law enforcement during air travel.

[I would be interested in knowing exactly which law enforcement agencies have been regarding Ahmed Shqeirat with increased scrutiny, so that I could commend them.]

As a result of US Airways and MAC [Metropolitan Airports Commission]’s conduct on November 20-21 [2006] and the following defamatory statements, Mr. Shqeirat’s reputation has been badly damaged. Mr. Shqeirat’s freedom to conduct meaningful business opportunities has been limited. Mr. Shqeirat is a businessman in addition to being a religious leader. Following the november 20-21 incidents, his transactions have been scrutinized delayed and his merchandise has been withheld.

U.S. Dept. of Transportation rules U.S. Airways didn’t discriminate against Flying Imams

An update on this story, found buried in a set of Associated Press news briefs — hence the highly unusual headline. “MINNESOTA: Man faces life … Mercury in fish … etc,” via the Grand Forks Herald, February 19:

Imams lose complaint: The U.S. Department of Transportation said an airline didn’t discriminate against six imams when it removed them from a flight at Minneapolis-St. Paul International Airport in 2006.

The department’s assistant general counsel, Samuel Podberesky, informed the Council on American-Islamic Relations of the department’s conclusion in a Jan. 14 letter.

But the department did fault US Airways for refusing to book the men on another flight after the FBI cleared them.

The letter is among several exhibits entered last week in a lawsuit the imams filed against the airline and the airport in federal court in Minneapolis. The trial is scheduled for August.

The men claim they were discriminated against because they appeared Middle Eastern and some of them prayed before boarding the flight.

An Austrian court has excluded a young Muslim woman from the start of her trial on terrorism charges because she refused to remove her full-face veil.
The suspect, identified as Mona S, is charged, along with her husband Mohamed M, with links to al-Qaeda and posting a threatening video on the internet.

The presiding judge ordered the woman to be escorted from the court, arguing the jury could not judge her without seeing her face.

Both suspects deny the charges. (they always do/ed)

Arriving at the court in Vienna, the young woman refused to take off her full-covering niqab because she said there were “too many men here”.

Mona S’s defence lawyer argued that her trial could be prejudiced.

‘Targets mentioned’

The couple, both Austrian citizens of Arab descent, were arrested in September 2007 after a video was posted on the internet threatening attacks in Austria and Germany if military personnel were not withdrawn from Afghanistan.

The video was signed “Global Islamic Media Front (GIMF)”.

The authorities say that the man mentioned possible targets such as the Euro 2008 football championship in internet chat groups frequented by radical Islamists. The woman is alleged to have translated Arabic texts into German.

The couple’s lawyer argued that GIMF was not a terrorist organisation and there was not the slightest evidence that the couple had any link to al-Qaeda.

The couple are married under Islamic law, but not under Austrian law, the court heard.

If found guilty, they could face up to ten years in prison. A verdict is expected later this week.

Protesters already have torched Dutch flags in Afghanistan ahead of a new Dutch film portraying Islam’s holy book as a “fascist” text that incites violence and preaches the oppression of women and homosexuals.

A Dutch Cabinet minister postponed his trip to Somalia on Friday due to “specific threats” linked to the film, and the Dutch government has urged lawmaker Geert Wilders to scrap his film for the safety of its citizens abroad.

But Wilders said Monday he has begun negotiations with Dutch broadcasters about airing the 15-minute film, “Fitna.” He said he will only allow them to show it in its entirety, and if they refuse, he plans to show it to the media and post it on the Internet.

“We have never learned to be intolerant toward people who are intolerant toward us, toward cultures that are intolerant toward us,” he said in a recent Associated Press interview.

The right-wing legislator previously warned of a “tsunami” of Islam swamping the Netherlands and said Muslims should tear up half of the Quran if they want to live here.

Wilders has lived under round-the-clock security since the 2004 murder of filmmaker Theo van Gogh by an Islamic radical enraged by his short film, “Submission,” a fictional study of abused Muslim women with scenes of near-naked women with Quranic texts engraved on their flesh.

The film “Fitna” — an Arabic word meaning discord — puts the centuries-old Dutch traditions of religious tolerance and freedom of speech on a collision course.

If it airs, Dutch Muslims are expected to file criminal complaints for racial or religious vilification. Prosecutors would then have to decide whether to charge Wilders with any offense.

“Our law is very clear — anybody can make a film. We have freedom of expression and you cannot restrict that,” says Moroccan-born Sadik Harchaoui, chief of the Forum Institute for Multicultural Development.

“Can you offend people? The answer is yes. I’m not saying you should do it or it is desirable, but you can,” he added. “But if the film is insulting and preaches hate, then the law has to take action.”

The Dutch Reject Blackmail & Intimidation, Support For Wilders Grows:

THE HAGUE, 04/03/08 – The Christian democrats (CDA) would only win 29 seats if general elections were held now. The disfavour of the voters is the result of the party’s attempts to prevent Geert Wilders’s film on the Koran from being shown, pollster Maurice de Hond reported.

Last week, CDA still scored 32 seats. The new result of 29 is the party’s lowest score since the spring of 2006. CDA currently has 41 seats in the Lower House, which has 150 members.

The three seats lost by the CDA would be divided between Wilders’ anti-‘Islamisation’ Party for Freedom (PVV), the conservatives (VVD) and Proud of the Netherlands (TON). Each of these parties would win one more seat than last week.

PVV (now 9 seats) and VVD (now 22 seats) would each win 16 seats. Proud of the Netherlands, the new party being set up by ex-VVD MP Rita Verdonk, would enter the Lower House with 19 seats, De Hond reports.

Verhagen

CDA Minister Maxime Verhagen appealed explicitly to Wilders on Thursday not to broadcast the film. CDA Prime Minister Jan Peter Balkenende also pressed the PVV leader on Friday to withdraw the film, although he worded this less strongly than Verhagen. In the Lower House, the CDA was the only party that supported Verhagen’s explicit call to drop the movie.

KABUL (AFP)--Tehran intends to expel all 1.5 million Afghans within its borders illegally, a visiting Iranian official said in Kabul Monday, even as Kabul said it could not cope with such a high number of returnees.

“Those who illegally entered Iran have committed crimes: entering illegally, staying illegally and working illegally – these are crimes,” Sayed Taghi Ghaemi, of the Iranian interior ministry, told reporters.

“We will expel them from our country at the first opportunity we encounter them,” he said on the sidelines of a meeting between both governments to assess the repatriation of Afghans from Iran.

Iran estimates there are about 1.5 million Afghans illegally within its borders with another 900,000 there as registered refugees. It began to force the illegals out nearly a year ago.

Ghaemi said the removals would be conducted in consultation with the Afghan government.

Kabul has, however, been urging Tehran to halt the expulsions, especially over the winter which has been one of the coldest in decades with about 1,000 people dying from the cold.

Deputy refugees minister Abdul Qadir Ahadi told the same news briefing that Kabul was not able to receive returnees in large numbers.

“Afghanistan’s problems are known to everyone,” he said. “In the current situation we’re overpowered to receive 1.5 million refugees at home,” he said.

In a recent mass expulsion, officials in the western province of Nimroz said about 1,800 Afghans arrived there on Saturday.

War-scarred Afghanistan is beset with insecurity linked to a growing Taliban- led insurgency, high unemployment and a lack of basic infrastructure.

Conflict, poverty and drought led to an exodus of Afghans that began in the 1970s and ended with about 8 million in exile in the 1990s. Most went to Iran and Pakistan.

Since 2002, after the fall of the hardline Taliban regime, around 4 million have returned. There are still 2 million registered Afghan refugees in Pakistan.

The managing editor of one of the country’s biggest newspapers thinks news organizations ought to hire more Muslim reporters.

Philip Bennett, the Washington Post’s managing editor, said reporters often struggle with understanding Islam during a speech Monday at UCI about the difficulties of covering the religion.

Bennett’s speech focused on the media’s need to cover issues concerning Islam in an in-depth, long-term manner.

To illustrate this point he drew mainly from quotes of notable colleagues and statistical polls, rarely giving his own opinion directly.

“Six of 10 Americans, according to a 2007 ABC Poll, don’t understand the basic tenets of Islam,” Bennett said.

He attributed this to the lack of Muslims working in American newsrooms.

“At the Post I want more Muslim readers and I want more Muslim journalists,” he said.

* We don’t. We don’t want it. We don’t need it. We need somebody with balls.We don’t need spin doctors to cook the news. We need somebody to kick ass: no more empty suits!

Words poorly translated from Arabic to English are a big source of confusion caused by the lack of Muslim voices in the American media, according to Bennett.

Zeyad Maasarani, 22, a Muslim reporter for California’s most circulated Muslim publication, Southern California in Focus, agrees with Bennett that terms like “jihad,” “madrasa” and “hijab” are a big source of the public’s misunderstanding of Islam.

“Jihad means holy war, which is the definition that most Americans know, but it also means struggle, and valiant attempt,” Maasarani said.

One such word that has been contentiously debated in newsrooms is “Islamist,” which generally refers to a political movement governed by Islamic law. Bennett said at the Washington Post editors still have not decided whether to add it to their style book.

Some argue the word is a useful distinction for movements like Hamas and Hezbollah, but others at the Post argue that it is too vague and should be omitted in favor of a more specific description.

Bennett spent most of his time recalling an anecdote about a misunderstood Muslim group in Walkersville, Md., who were trying to purchase a large amount of land for a retreat.

The Ahmadiyya, an Islamic sect considered heretical through much of the Muslim world, did TV interviews, town hall meetings and even door-to-door interviews to try to convince the people of Walkersville that they meant well, according to Bennett, but the county zoning board ultimately denied permission to buy the land.

He cites cursorily researched articles in the local and national newspapers that neglected to figure out who the Ahmadiyya really were as a primary reason that their proposal was met with massive protests.

Bennett said that in the period following 9/11 there was a lot of uninformed writing about Islam, and that “the best journalism fought against the tide of public perception.”

Pace Student Who Dumped Korans in Toilet Gets Community Service

Charges reduced from ‘hate crime’

NEW YORK (AP) — A former Pace University student who twice threw copies of the Koran into a toilet at the school after disputes with Muslims pleaded guilty Monday to disorderly conduct in connection with the incidents.

Stanislav Shmulevich, 24, pleaded guilty as part of a deal in which he must do 300 hours of community service. He has completed about 80 hours of the service at a hospital, his lawyer said.

Shmulevich, of Brooklyn, admitted he tossed the Muslim holy books into toilets at Pace on Oct. 13, 2006, and Nov. 21, 2006. A criminal complaint says the Koran that was recovered in the October incident “was covered in feces.”

In both cases, a teacher found the books in a men’s room on the second floor of the school’s main building in lower Manhattan.

Muslims consider the Koran a sacred writing that contains the direct word of God Allah, and desecrating it is seen as an offense against God.

His lawyer, Glenn Morak, said he believed the disorderly conduct plea was an appropriate disposition.

“There was no hate crime here,” Morak said. “He accepts responsibility, and he is repentant.”

Shmulevich, the lawyer said, is no longer at Pace, which has about 14,000 students on its campuses in New York City and Westchester County.

PHILADELPHIA – The Muslim Weekly, a London-based publication, issued an apology today to Daniel Pipes, director of the Middle East Forum, concerning a defamatory article it published in February 2007.

That article repeated a false allegation made by Tariq Ramadan that Daniel Pipes had lied to a conference hosted by London mayor Ken Livingstone in January 2007. (For details of what did occur, see the article by Mr. Pipes, “Is Tariq Ramadan Lying [about Magdi Allam]?”)

Upon receipt of a libel complaint from Mr. Pipes, the Muslim Weekly accepted that Mr. Pipes spoke accurately at the conference and that he did not lie. The Muslim Weekly apologized to Mr. Pipes for the distress caused by the article. The Muslim Weekly’s retraction, published both in print and online in the Feb. 29, 2008 issue, reads in full as follows:

On February 9, 2007, the Muslim Weekly published an article, “World civilisation conference: Professor Tariq Ramadan on Islamic Threat,” under the byline of Dr. Mozammel Haque, concerning a speech given by Professor Ramadan on 20 January 2007. We reported that he accused Professor Daniel Pipes, an American specialist on the Middle East, of lying in his speech to the same conference about the religion of an Egyptian Muslim. We now understand that Professor Pipes spoke accurately and that he did not lie. We retract what we wrote about him and apologise to Professor Pipes for any distress caused by our article.

Reacting to this apology, Mr. Pipes said: “I am delighted that Muslim Weekly recognizes there is no truth whatsoever in Tariq Ramadan’s allegations concerning my statement at the World Civilization Conference, and that it has forthrightly set the record straight.”

The world body can not currently hold direct talks with Hamas, which runs Gaza after winning Palestinian elections but which is considered an illegal extremist group by many UN member states.
“It is imperative that every effort be made to bring the violence to an end. This can be done only by negotiation and mediation,” said John Dugard, the special rapporteur on Palestinian human rights.  (for terrorists)
