Conflicting Reports
From Dutch News:
Find Wilders not guilty of insulting groups, prosecutors tell court
Anti-Islam politician Geert Wilders should be found not guilty of insulting Muslims and non-western immigrants as a group, the public prosecution department said at the MP’s trial on Tuesday.
By likening the Koran to Hitler’s Mein Kampf, Wilders was focusing on Islam and the Koran, rather than Muslims, even if the statement can be considered upsetting, the public prosecutors said during court hearings in Amsterdam.
In addition, there can only be talk of collective insult when a statement damages the entire group, the prosecutors said.
Second week
The public prosecutors began outlining their sentencing demands on Tuesday, in the second week of the MP´s trial.
In addition to group insult, Wilders has also been charged with discrimination and inciting hatred.
The department will outline its case and sentence demand on those charges on Friday.
The department has also said that none of the groups and individuals making formal complaints about Wilders are eligible for damages.
But then we have this:
“The Truth is No Defense”
“No matter whether Wilders’ publications are true or not, this does not mean that he can express those as facts”
Robert Spencer received the following message earlier today from a reader in the Netherlands:
If it is  illegal in the Netherlands to tell the truth, then the light of freedom is in imminent danger of going out not just in the Netherlands but all over the West.
Dear Mr. Spencer,At 09.45 Amsterdam local time the prosecution stated that “no matter whether Wilders’ publications are true or not, this does not mean that he can express those as facts”.
This means telling the truth, even well documented, can still mean jail is coming.
So, apparently The Netherlands are already back in the dark ages.
UPDATE: Yes, it’s accurate. “Prosecutors: Dutch anti-Islam politician can’t defend himself by arguing his comments are true,” from The Associated Press, October 12:
AMSTERDAM — Prosecutors say Dutch politician Geert Wilders cannot defend himself on hate speech charges by arguing that remarks he has made critical of Islam are true. They say there is no general agreement about the nature of Islam and his statements are only his opinion….
Prosecutor Birgit van Roessel said at the start of her closing arguments Tuesday that the right to freedom of speech has limits, including when it infringes too far on the right of freedom of religion….
