Palestinian Researcher Dr. Sari Nusseibeh on the Return of Palestinian Refugees

Following are excerpts from an interview with Dr. Sari Nusseibeh, Dean of Al-Quds University, which aired on Al-Jazeera TV on November 30, 2007:

Dr. Sari Nusseibeh: We have rights – such as our right to live a free life, to establish a state, the right to build a future, and the Right of Return. The Right of Return is one of our rights, but unfortunately, we are living in a world that demands – if we want to make any progress – that we choose some of these rights, at the expense of the full implementation of the rest. The question that should be discussed by the Palestinians – and all the Arabs – is whether we really want a two-state solution or not.

What I am saying is that the implementation of the Right of Return should be carried out within the framework of the future Palestinian state.

The Israelis now living in the territories of the future Palestinian state should return to living within the borders of the state of Israel. No Jew in the world, now or in the future, as a result of this document, will have the right to return, to live, or to demand to live in Hebron, in East Jerusalem, or anywhere in the Palestinian state.

If this cause is the cause of the refugees – so be it, but then the Palestinian people should make a clear decision that it does not want a state. If that is the case – so be it, and all we should demand is the refugees’ return and equal rights. I was the first who demanded that.

Two suspected al-Qa’eda operatives released from Guantanamo Bay have walked free from court although they are still wanted in Spain on terrorism-related offences.

One of the men, who is accused of distributing extremist propaganda produced by Osama bin Laden, had half of his £50,000 bail surety met by the actress Vanessa Redgrave.

The other man, Omar Deghayes, 38, a Libyan national freed from Guantanamo and allowed into the UK because he once lived here, is said to have had links to the same al-Qa’eda cell. He was also released on bail.

Spain issued European arrest warrants for both men within hours of their arrival in Britain last night from the Cuban detention centre. Miss Redgrave said: “It is a profound honour and I am glad to be alive to be able to do this.”

She added: “Guantanamo Bay is a concentration camp. It is a disgrace that these men have been kept there all these years.”

But the City of Westminster Magistrates’ Court heard of their alleged links to al-Qa’eda, which raised fresh questions over why the British government interceded on their behalf to allow their return here from Guantanamo.

Although the men have been resident in the UK and have family here, they are not British citizens.

Previously, the Government has said it owed them no legal obligations.

Melanie Cumberland, for the Crown Prosecution Service, said Mr el Banna was a Pakistani who had first come to Britain in 1994 on a false Kuwaiti passport.

Update: Bin Laden’s driver is not POW, judge says

Osama bin Laden’s driver is not a prisoner of war as defined by the Geneva Conventions and can be tried by a Guantanamo war crimes tribunal, a U.S. military judge ruled in a decision made public on Thursday.

The judge said Yemeni prisoner Salim Ahmed Hamdan is an “unlawful enemy combatant” under the law passed by Congress last year to provide a legal basis to try non-Americans on terrorism charges in a special war crimes court at the U.S. naval base in Guantanamo Bay, Cuba.

Lawyers for Hamdan, who acknowledge he earned $200 a month driving and guarding the al Qaeda leader in Afghanistan, said he was a civilian support worker who should be considered a prisoner of war deserving of the safeguards outlined in the Geneva Conventions that govern the treatment of war captives.

POWs can be tried by court-martial but not in ad hoc tribunals such as those still evolving at Guantanamo. A finding that Hamdan was a POW would have raised questions about the status of many of the other 285 men held at the Guantanamo prison camp, most for more than five years.

The ruling by the military judge, Navy Capt. Keith Allred, clears the way for Hamdan’s trial in the Guantanamo war court, where he faces life in prison if convicted of conspiracy and providing material support for terrorism.

It will be the third attempt to try him after earlier charges were thrown out by the U.S. Supreme Court and Allred.

The widely criticized Guantanamo court has yet to see a trial completed. The lone conviction came in a negotiated guilty plea for an Australian now nearing the end of a nine-month prison term in his homeland.

The Bush administration has long argued that the alleged al Qaeda and Taliban operatives at Guantanamo are not POWs because they are not members of the uniformed army of any nation.

CAPTURED NEAR KANDAHAR

Allred said Hamdan’s lawyers had shown no evidence that he was part of any army, militia or volunteer group granted “lawful combatant” status under the Geneva treaties, or that he played a support role for any such group.

The judge based his ruling on evidence and testimony during a hearing at Guantanamo earlier this month.

Bob Ayers, associate fellow for international security at London-based thinktank, Chatham House, told Adnkronos International (AKI) on Friday, while police successfully foiled the planned terrorist attack in Germany last month, more attacks were inevitable.

Diana West: Making sense in a desert of insanity

According to the PC script of the “international community” we never, ever discuss the Islamic context of “Arab-Israeli” conflicts. But how else can we hope to understand them? Jihad ideology inspires the Arab struggle against Israel. It also explains it. As the only non-Muslim country amid Middle Eastern Dar-al Islam, as the only “dhimmi” nation to reclaim its land once conquered by Islam, Israel’s very existence is a religious offense to the “umma,” or Islamic community. In this same context, what we call “foreign aid” to the PA may be understood as a form of “jizya,” the protection money paid to Muslims by non-Muslims.

But the non-Muslim world prefers not to think like that. We avert our collective eye from the goals of jihad, from the history and teachings of Islam. Instead, we see ourselves as villains — Israel for its existence, and Israel’s supporters for, well, their support for Israel’s existence.

In so doing, we create a sinkhole of Western guilt and responsibility for suffering Muslims, in this case in the PA. They suffer not as a consequence of their religio-political bloodlust to destroy the Jews in Israel (the nearest infidels), but because there are Jews in Israel. In other words, it’s everyone else’s fault but their own. Islam — particularly, jihadist ideology — is not to blame. Throw more money down the hole.

Of course, this works only until we stop misreading such ideology. And how long will that take? Probably forever-so long as we continue leaning on the same authorities who got us into this mental mess in the first place.

MADRID – Muslim religious leaders in Spain believe members of the security services are increasingly using “over zealous” methods to persuade members of their faith with links to mosques to become informers. Mosques in Madrid, Toledo, Valladolid, Barcelona, and Granada have reportedly been targeted by men claiming to be undercover police. The Interior Ministry says that it has no knowledge of any incidents, and that it requires “specific reports” to be able take any action.

Omar Hajjami, a 27-year-old butcher from Marrakech in Morocco, who has been resident in Spain for six years and is a member of Valladolid’s Islamic council, says he was approached a year ago by two men claiming to be secret police. “They came up to me in a gas station and asked if they could talk to me. They then gave me detailed information about my personal life.” He says that they asked him to collaborate with them and to provide information about leading figures in the Islamic community. Hajjami admits he was frightened, and told them he would think about their request.

Two days later one of the officers called to accuse him of smuggling drugs. “If they can accuse me today of that, then tomorrow they can say I sell arms,” he says.
After the two men refused to fully identify themselves, Omar decided to leave Spain, returning to Marrakech with his wife and two children. But as soon as he returned two months later, he was immediately contacted by the two supposed police officers. He agreed to meet them, and this time they threatened him with a gun, saying that they would send him to a prison in Morocco.

Finally, after continued harassment, Omar reported the matter to the police in Salamanca. So far they have been unable to identify the alleged police officers. At a recent Islamic conference of religious and community leaders held in Segovia, several speakers reported similar incidents. They said that they had not reported them out of fear of reprisals.

ABU Dujana, the self-described military commander of the Islamic extremist group behind the Bali bombings, has a chilling Christmas message for tens of thousands of Westerners in Indonesia, including Australian tourists in Bali.

Asked if more terrorist attacks were planned, the captured leader of Jemaah Islamiah said: “There are other cadres out there … it is their obligation.”

“Bucktooth Bashir was JI-leader for years!”

Abu Dujana has told prosecutors that the controversial Muslim cleric Abu Bakar Bashir was the group’s emir, or spiritual leader, for years.

Bashir, cleared by Indonesian courts of any involvement with terrorism, continues to preach anti-Western hatred in Indonesia.
He warned last week of a “disaster” if the three Bali bombers on death row — Amrozi, Imam Samudra and Mukhlas — were executed.

Abu Dujana, a father of four, has known Bashir since 1989, the year he went to Pakistan to train as a terrorist. We meet him at a South Jakarta court, where he faces a possible death sentence on multiple charges for supporting terrorism in Indonesia between early 2004 and June this year, when he was wounded during a shoot-out with Indonesia’s counter-terror police.

Slight and wiry, with a wispy beard, Abu Dujana smiles wryly and declines to answer when pressed on the whereabouts of his friend Noordin Mohamad Top, South-East Asia’s most wanted terrorist, and other JI members wanted over bombings in Indonesia.

The arrest of Abu Dujana and another JI leader, Zarkasih, in central Java on June 9 was a crippling but not knockout blow for JI, which has not carried out a bombing since 2005, security analysts in Jakarta say.

Abu Dujana had arranged for 200 kilograms of chlorate potassium, 12 kilograms of TNT and other explosive material to be sent to Islamic extremists in the central Sulawesi town of Poso, where about 2000 people have been killed in religious fighting since 1999.

When Noordin and other JI terrorists were on the run after masterminding bomb attacks, Abu Dujana gave them shelter and organised fake identity cards.

During questioning in late June and August, he gave investigators detailed information about JI and its splinter groups.

“He gave us more information than what was in the interrogation report,” prosecutor Totok Bambang said. “We gave him the so-called soft approach … we approached his family. We helped them financially.”

Although the capture of JI leaders has fractured the organisation, security analysts in Jakarta warn there are still dangerous terrorists at large, including Noordin and a bomb-making expert called Dulmatin.

Keith Loveard, an analyst with Concord Consulting, an Australian-owned security company based in Jakarta, said that radical Islamic sentiment was growing in Indonesia, driven in part by a decades-old push for the creation of an Islamic state, and by external factors such as the wars in Iraq and Afghanistan.

Earlier this week dozens of Muslim activists attacked the settlement of Ahmadiyah, an Islamic sect in West Java whose members believe that Muhammad was not the final prophet, contradicting a central tenet of mainstream Islam. Although Australian and other foreign governments continue to issue warnings about the threat of terrorist attacks in Indonesia, hotels in Bali are packed with tourists.

In Jakarta, hundreds of foreigners congregate nightly in nightclubs in well-known expatriate areas such as Bloc M.

Amrozi, Imam Samudra and Mukhlas, who face execution for the 2002 Bali bombings that killed 202 people, have been given one month to seek clemency from President Susilo Bambang Yudhoyono.

Islamic pressure closing churches in Indonesia

(CWNews.com) – The Indonesian Catholic bishops have called public attention to rising Islamic pressure against Christian churches, Vatican Radio reports.

Bishop Martinus Situmorang of Padang, the president of the country’s episcopal conference, is the co-author of a new report on the campaign by Muslim activists to close down Christian churches. The report shows that from 2004 through 2007, 108 churches have been closed because of Islamic pressure.

The report notes that Indonesia’s constitution guarantees freedom of religion and challenged the government to honor that promise, protecting the Christian minority from Muslim extremists.

Minister won’t block Haneef visa

IMMIGRATION Minister Chris Evans says he will take no action to cancel the work visa of former terror suspect Mohamed Haneef after it was effectively reinstated by an appeal court today.

The full bench of the Federal Court today dismissed an appeal lodged by Federal Government lawyers against a judge’s decision to reinstate Dr Haneef’s visa.

As things stood, the former Gold Coast doctor was now free to return to work in Australia, Senator Evans said.

Former federal immigration minister Kevin Andrews cancelled Dr Haneef’s visa on character grounds after terror-related charges were laid against him. Those charges were later dropped.

Senator Evans said he had reviewed the latest Australian Federal Police information on Dr Haneef and found there was no basis to cancel his visa on character grounds.

“I formed the judgment there was no basis for me to seek to move to cancel Dr Haneef’s visa,” he said in Perth.

“The effect of that is that Dr Haneef’s visa stands as valid.

“Dr Haneef is therefore entitled to return to this country and take up employment in accordance with his 457 visa.”

Senator Evans also said he was seeking solicitor-general’s advice on the Federal Court’s interpretation of the Migration Act, and had not ruled out a possible appeal to the High Court.

However, he was not inclined to pursue an appeal at this stage.

The Government could also consider changes to the Migration Act, he said.

Australian Federal Police arrested Dr Haneef at Brisbane International Airport on July 2 as he attempted to board a one-way flight to India, just days after failed terror attacks in Britain.

He was held for 12 days before finally being charged with providing support to a terrorist organisation for giving his mobile phone SIM card to his cousin Sabeel Ahmed, one of the men accused of the attempted UK bomb attacks.

The charge was dropped a fortnight later after Commonwealth Director of Public Prosecutions Damien Bugg found there was no reasonable prospect of securing a conviction against the 27-year-old.

However, Mr Andrews had already cancelled his visa on character grounds, meaning Dr Haneef was unable to return to work at the Gold Coast Hospital.

Dr Haneef has spent most of the past five months at his family home in Bangalore but his lawyer has repeatedly said the doctor wants to return to work on the Gold Coast.

Haneef may seek compensation

THE lawyers for former terrorism suspect Mohamed Haneef have said that their client was considering seeking compensation.

Dr Haneef’s lawyer, Peter Russo, said a decision was yet to be made about whether Dr Haneef would seek compensation.

The counsel representing Immigration Minister Chris Evans has applied for the judge’s decision to be stayed pending a possible appeal to the High Court.

Dr Haneef’s barrister, Stephen Keim SC, opposed the application and said there was no justification for it as his client’s life should not be disrupted further.

Dr Haneef has spent most of the past five months at his family home in Bangalore.

He is now in Mecca in Saudi Arabia on the annual Muslim pilgrimage.

David Hicks was ready to die a Muslim ‘martyr’

DAVID Hicks’s enthusiasm for dying as a Muslim martyr has been revealed in a letter he wrote to his mother while he was training with al-Qaeda in Afghanistan in 2001.

The letter is one of a series released by the Australian Federal Police as part of their bid to persuade a federal magistrate that the confessed terrorist, who is due to be released from an Adelaide jail on December 29, should become only the second Australian subject to a terrorism control order.

“There are many privileges in heaven,” Hicks said in the letter.

“One reward I get in being martyred – I get to take ten members of my family to heaven who were destined for hell. But first I also must be martyred.

“Islam will rule again but for now we must have patience … we are asked to sacrifice our lives for Allah’s cause – why not?”

Hicks also described himself as a “fit, young Muslim, ready to defend Islam”, and in another letter wrote of the “poison” of the West, which he said was trying to crush Islam.

“Jihad is still valid to this day,” he wrote.

Barrister Andrew Berger, for the AFP, yesterday outlined the sophisticated terrorism training Hicks underwent at camps in Afghanistan and Pakistan, where he learned to use shoulder-mounted anti-aircraft missiles capable of bringing down airliners.

Mr Berger said the evidence repudiated any suggestion that Hicks was “all talk, no action”.

“Rather than a dog whose bark was worse than his bite, (Hicks) has demonstrated a willingness to take action,” Mr Berger said.

Defaming Islam

According to CNS news, the UN General Assembly has passed a resolution against the “defamation of religions”, especially Islam.

I’ve never felt a particular need to defame Islam, since Islam is perfectly capable of defaming itself.

But this, of course, is hate speech, not to mention racism and xenophobia, and is thus defamatory in its own right. Once the UN gets its way, I won’t be able to say it anymore.

The anti-religious defamation resolution was introduced by the OIC as a corrective to the Islamophobia revealed by the Mohammed cartoon crisis in Denmark. It has been kicking around the UN in committee for a couple of years, and generally flew under the radar until it was passed by the General Assembly this week without attracting any undue attention.

What makes the UN resolution different from the EU’s initiatives — and what probably caused some European countries to vote against it — is that the UN version mentions Islam as a specially protected religion. No other religion is specified in it. The United Nations now makes it official: Islam has been elevated above other religions, and has effectively become the established religion at the UN.

The Islamic countries of the OIC are well-versed in human rights jargon, and have used it to great effect in this resolution. The text asserts that “respect for cultural, ethnic, religious and linguistic diversity, as well as dialogue among and within civilizations, is essential for peace, understanding and friendship among individuals and people of the different cultures and nations of the world”, and wants “to promote greater harmony and tolerance in all societies”.

But the wording leaves no doubt about which religion and culture it intends to protect. The resolution:

Opposes “the introduction and enforcement of laws that specifically discriminate against and target Muslims”;

Points out “the increasing trend in recent years of statements attacking religions, Islam and Muslims in particular, especially in human rights forums”;

Asserts that “Islam is frequently and wrongly associated with human rights violations and terrorism”; and

“Stresses the need to effectively combat defamation of all religions, Islam and Muslims in particular, especially in human rights forums”.

The camel’s nose under the UN human rights tent is the concept of “racism and xenophobia” as a violation of human rights. Conflating the fear of Islam with racism and/or xenophobia is a well-established technique for placing criticism of Islam out of bounds. Such logic is fundamentally flawed — Nigerian Christians are, after all, the same race and nationality as the Muslims who burn their churches, but any mention or criticism of such an issue will be forbidden under the UN’s guidelines.

My Prayer for the Jewish People

As a Zionist Muslim clergyman and a friend of the Jewish people, I cannot keep silent. I feel a moral urge to declare that the nations of the world are once again preparing bad days for the Jewish people.

A US Administration, which pays lip service to a supposed “war on terror,” is ready to bow to Saudi-funded Islamist terror and to accept the Saudi diktat compelling Jews to withdraw from the Land of Israel. The Jewish people is at risk of getting restricted by order of its American “friends,” ever closer to what Abba Eban used to call “the Auschwitz borders.”

People are rarely satisfied with their politicians, and the case of contemporary Israelis is no different. Most of them feel betrayed by both leftist politicians who try to introduce surrender to Abu Mazen as a “step toward peace,” and by reputed nationalist politicians who declare they oppose Jewish deportation from Judea and Samaria, but who do not move a inch to prevent it.

The more time passes, the more moral leadership of the Jewish people at home is restricted to a powerless minority. The nightmare of Oslo returned and became even darker in Annapolis. That was the reason for the recent creation in Jerusalem of the New Jewish Congress, a federation of different authentic Zionist groups and organizations, blessed by the New Sanhedrin and by the most authoritative Israeli rabbis, and supported by 30% of concerned secular Israelis. I regretted being unable to attend the founding session, held in Jerusalem, Israel, on November 27, but I was thankful to Allah the Most High for giving me the opportunity to thank Prof. Hillel Weiss for the honor of the invitation and to send the participants my greetings.

I was glad to have been given the opportunity to reiterate that the territories of Judea and Samaria are the home Allah granted to the Jewish people, and that any attempt to steal them from their legitimate owners is a declaration of war against a Divine decree. In my humble view, each of my Jewish brothers and sisters is morally obligated to struggle for the integrity of the Land of Israel, in order to ease the task of the Jewish people to be a “light unto the nations” and to pave the way for Redemption.

* How many times did we see Western dhimmi governments commission expensive studies on the Muhammedan problem only to to come up with the same results we have seen years before? Once again we are told hat only 6 % of Germany’s 3 million Muslims are supposedly radicals who would use violence. And of course this is entirely our own fault because we somehow ‘failed to integrate or assimilate them.’ The predictable result of this bullshit study like all the others before it will be that Muslim immigration continues unhindered and the government will throw more money at the problem, but integration will not happen. On the contrary: it is them who will assimilate us.

Germany has around 3 million Muslims, if 6% have “violent tendencies,” then there are 180,000 jihadis drooling at the thought of killing us kufr. On the plus side, if everyone one of them is killed, that would be 12,960,000 virgins Allah would have to serve up. Isn’t math fun!…

A new study released by Germany’s Interior Ministry has added new fuel to the debate about integration of Muslims in Germany, with the report warning about the danger of radicalization of Muslims.
According to the study, which was published Tuesday, around 40 percent of Muslims surveyed had a “fundamentalist orientation,” which the authors defined as a strongly religious worldview and moral values.

In concluding that 6 percent of Muslims in Germany have violent tendencies, the study appears to contradict to some extent the findings of Germany’s domestic intelligence agency, the Office for the Protection of the Constitution, which monitors Islamist activity in the country. According to its 2006 report, there are currently around 32,000 Islamists in Germany who pose a potential security threat. That figure represents slightly more than 1 percent of the around 3 million Muslims who live in the country.

However, the authors concluded that the vast majority of Muslims in Germany reject religiously motivated terrorism and violence: Some 92 percent of respondents agreed with the statement that terrorist acts in the name of Islam were a serious sin and an insult to Allah.

But the authors saw a potential threat in a small minority with Islamist leanings: Around 6 percent of those surveyed were classified as having “violent tendencies,” while 14 percent of respondents had “anti-democratic” tendencies.

Around 12 percent of the Muslims in Germany identified with a religious-moral critique of the West and supported corporal punishment and the death penalty. The report also concluded that religious beliefs are becoming increasingly important for young people.

The study, which was carried out by Katrin Brettfeld and Peter Wetzels from the Institute for Criminology at the University of Hamburg, was commissioned by the Interior Ministry in an attempt to finding out the extent to which the Muslim community in Germany provides a breeding ground for extremist groups and potential terrorists. The authors interviewed 1,750 Muslims living in Germany for the study. Of that number, around 40 percent had German citizenship.

Milan imam convicted for promoting jihad

MILAN, Dec 20 (Reuters) – A Muslim cleric who preaches at a Milan mosque and 10 other people were convicted on Thursday of being part of a group that promotes jihad.

The Milan court sentencedAbu Imad to three years and eight months in prison under anti-terrorism statutes drafted before Sept. 11 that are weaker than those currently in place.

The group was accused of promoting jihad and recruiting potential suicide bombers.

A source at the Milan’s prosecutors’ office said however investigators did not believe Imad was still a threat and was allowed to remain free pending an appeal.

Sentences for the other accused ranged from two to 10 years in prison.

Abu Imad preaches at the Viale Jenner mosque in Milan, which the United States once accused of being a European logistics base for al Qaeda.

It was the same mosque where Muslim cleric Hassan Mustafa Osama Nasr, also known as Abu Omar, preached before Italian prosecutors believe he was kidnapped in 2003 by a CIA-led team as part of the secret U.S. rendition programme.
